I for one am happy to be anti-drowning

I’m almost irrationally furious about this.

Wednesday’s event by the Bayou City Initiative was billed “Flood Resiliency and the State of City Infrastructure.” So, it was no surprise to see featured speaker Carol Haddock, head of Houston Public Works, get asked what the city department in charge of drainage and roads has done to prepare itself for the next storm.

Haddock started by saying the department had provided swimming lessons to its staff.

“I’m proud of that,” she said later.

There was more to the answer Haddock provided, including information on ditch clearing and updates to major projects before three successive years of deadly flooding and some projects still to come. Those details just came after the bit about teaching dump truck drivers how to swim.

“Why in the world would that be the first thing out of her mouth?” mayoral candidate Bill King said. “At first I thought it was a joke, but then it was clear she was serious. It was so bizarre.”

King, who often takes to Twitter, did just that, twice, lambasting Haddock.

“You can’t make this stuff up,” he tweeted. “Would love to see who got the contact (sic) to conduct the swimming lessons.”

After the flooding related to Hurricane Harvey, public works staff were asked how the city’s response could be improved, something Haddock said typically is asked after any major event.

Because the department has big trucks, and big trucks can travel in water deeper than conventional cars and trucks, some public works workers are called into service as first responders — either driving police and fire workers into flooded areas or closing off roads.

Many told Haddock and other public works officials they could not swim, but they wanted to help out in floods.

Haddock hooked up interested employees with a Saturday swim lesson at a city pool, taught by parks department instructors and firefighters. The lesson included basic swimming skills, how to secure a rope and proper use of objects to help someone in high water.

The public works employees did it on their day off, Haddock noted.

Yes, Bill King, coddled rich guy who wants to be Mayor, talked shit on Twitter about city employees who asked for swimming lessons so they could do more to help with rescue operations during floods. Bill King, pampered swell who doesn’t want for anything, sneered at people whose first instinct in a disaster is to think of others. Bill King, living a life of leisure on the wealth of a golden retirement portfolio, looked down his nose at working folks who gave up their Saturday so they could be a bigger part of the solution during the next Harvey. As that embedded cartoon says, “Christ, what an asshole”.

Mediation fails again

Not really a surprise.

A third round of mediation between Mayor Sylvester Turner and the Houston firefighters union concluded in an apparent impasse Thursday afternoon, ending another attempt to resolve the long-running contract dispute and sending a lawsuit over the matter back to a state appellate court.

The mediation session, ordered by Texas’ 14th Court of Appeals, ended around 2 p.m. at the office of the Baker Botts law firm. After leaving the meeting, Houston Professional Fire Fighters Association President Marty Lancton said city officials “walked” and “absolutely decided they were not going to continue” the session.

“It was crystal clear to myself and to our team that this mayor was not interested in resolving this,” Lancton said. “This is a game of politics by this mayor trying to get past the election.”

The story says that the 14th Court of Appeals will likely not render a verdict until after the election. And let’s be clear, if this election was illegal as the lower court ruled, then there really isn’t much basis for mediation. The city’s position can and should be that any negotiations should be done in the context of the normal collective bargaining process, as the firefighters have been operating without a new agreement for a couple of years now. The firefighters have a good argument that some form of pay parity should be the goal of those negotiations, since the people did vote in favor of Prop B. Unless the 14th Court eventually decides that the lower court ruling was wrong, I’m honestly not sure what else there is to talk about at this point.

Most of the District D contenders entered the race after Dwight Boykins announced his candidacy for Mayor, so it’s not too surprising that many of them have no report filed. As such, and given that they’re almost all first-time candidates, it’s hard to guess who may be viable. If you dangled me off a bridge I’d pick HCC Trustee Carolyn Evans-Shabazz and former Geto Boy Brad Jordan as the two most likely to make it to a runoff, but that’s in the absence of a lot of information. Ask me again when the 30 day reports are posted, especially if Boykins has not retreated back to this race. Jordan got a lot of press when he announced his entry into the race, and did this interview in June (which I have to say doesn’t raise my esteem for him), and has a domain with a placeholder webpage at this time.

Districts F and J are racially diverse, low-turnout places where it can be hard to get a handle on who’s actually a contender. The last four Council members in F have all been Asian Americans, with the three most recent being Vietnamese, but there’s no reason why that has to be the case. Money is a weak indicator as well, with Richard Nguyen coming out of nowhere to beat then-incumbent Al Hoang, who supplemented his own fundraising, in 2013. He was then defeated by Steve Le in 2015. Tiffany Thomas is a former Alief ISD Trustee, making her the most successful of the candidates with past experience running for office. Jim Bigham ran against term-limited incumbent Mike Laster in 2015, while Edward Pollard unsuccessfully challenged State Rep. Gene Wu in the 2016 Democratic primary. (If you click that link, you will see that there was some ugliness in that race.) Nelvin Adriatico, who filed a report in January, was one of the first candidates for any office to appear on the scene, while Anthony Nelson is among the multitude of younger candidates on the ballot this year.

For At Large #5, it sure looks like it’s Sallie Alcorn and everyone else. She put up big numbers in January as well. Money is less of an issue in district races, where you can knock on a bunch of doors and visit all the civic clubs and neighborhood associations and whatnot and put yourself in front of most of your voters that way. For At Large you need other ways to let people know that you exist as a candidate, and nearly all of them require money. The other way is to run for something every election so that people eventually recognize your name even though you don’t do any actual campaigning. This is the Brad Batteau strategy, and much like the maybe-absent (but don’t say that out loud till the filing deadline) Griff Griffin it will get you some votes. Activist Ashton Woods, the only other AL5 candidate I’m familiar with, filed a correction affidavit on July 23 attesting that server issues on July 15 caused an error the submission of his finance report. I presume that means another report will be posted, but as yet I don’t see it. Alcorn is former Chief of Staff to Steve Costello and has done a lot of other things with the city as well.

Lastly, in searching for a website relating to Carolyn Evans-Shabazz’s Council candidacy (she has a Facebook page but not a website as far as I could tell), I stumbled across this delightful interview she did with four young children when she was a candidate for At Large #5 in 2013. There are other such interviews running through the 2015 election. The BigKidSmallCity domain those were a part of is now redirecting here, so I’m guessing there won’t be more of these conversations, but let me just say that if there is one thing that we could really use right now, it’s this. Please, Jill B. Jarvis, do this again. Thanks very much.

District A is pretty straightforward. Amy Peck, currently the Chief of Staff for incumbent Brenda Stardig and a two-time candidate (2009 and 2013) before this, is the seeming front-runner. She’s the fundraising leader and there are no other brand-name Republicans in this race for an open Republican seat, which when you look at the field size in basically every other open seat race is kind of a miracle. That said, her haul so far is hardly a deterrent, and there’s still a few weeks for anyone on the fence to jump in. If the election were today, I’d make her the solid favorite. Ask me again after the filing deadline.

District B is always a fascinating mixture of experienced candidates with solid backgrounds and resumes, perennials and gadflies, and intriguing outsiders who could upend the conventional wisdom. Alvin Byrd has been Chief of Staff to two different Council members. Tarsha Jackson was a force with the Texas Organizing Project with a long record of advocacy on criminal justice issues. Cynthia Bailey is a longtime civic activist who’s leading efforts to fight illegal dumping and clean up trash. Renee Jefferson Smith had a day named for her by City Council following her Harvey recovery work. And of course, there’s Willie D of the Geto Boys. He joined the race too late to do any fundraising; the others I named account for the bulk of what has been raised, with Smith in the lead. There are some great candidates running here in a race that won’t get much attention outside the district. That’s a shame.

The district that will get most of the attention, only partly because about half of all the candidates running for anything are here, is district C. Abbie Kamin is the fundraising powerhouse by far, but it’s a big field and it won’t take that much to make it to the inevitable runoff. Kamin is an advocate for voting rights and refugees and generally makes you wonder what you’ve done with your entire life when you look and she what she’s done so far. This is a purple district with a roughly even mix of Republican and Democratic candidates, with Kamin, 2010 candidate for HD138 Kendra Yarbrough Camarena, and entrpreneur/activist Shelley Kennedy as the leading contenders in the latter group. (Nick Hellyar was there with them till he moved to the At Large #4 race.)

Mary Jane Smith is the leading fundraiser among the Republican candidates. Interestingly, her bio notes her political activism and campaign experience, but doesn’t say which party she’s been active with. That’s easy enough to figure out with a little Google searching, but I do find it curious that she wouldn’t fly her flag proudly on her own webpage. (Also, too, if you were a power broker in the last election for a county party chair, you aren’t an “outsider” in any meaningful political sense.) Anyway, Greg Meyers is a former HISD Trustee who ran against State Rep. Hubert Vo a few years ago, and Daphne Scarbrough (you can find her webpage yourself) is a longtime anti-Metro zealot. And yes, Anthony Dolcefino is the son of Wayne. You can’t say there aren’t choices in this race. I’ll fill you in on the rest tomorrow.

Still tweaking the Metro referendum

Extending one rail line to Hobby Airport instead of two has generated some savings in the projected cost, which can then allow for other things to be done.

The expected price of extending the Green Line and Purple Line light rail to Hobby Airport, by combining the two lines and focusing on a route along Broadway, dropped from $1.4 billion to about $1 billion, Metropolitan Transit Authority officials said Friday.

Metro’s board is nearing a final vote on asking voters for permission to borrow $3.5 billion for a suite of transit projects, the first portion of the agency’s MetroNext long-range plan. Officials must approve a plan by mid-August and call for an election, in order to have it appear on the November ballot.

Likely projects for the ballot proposal include extensions of the Red, Purple and Green light rail lines, 75 miles of proposed bus rapid transit and various park and ride additions or expansions.

Because of the estimated $400 million savings, those projects could be joined by a $336 million extension of the light rail line from Hobby to the Monroe Park and Ride lot near Interstate 45, and relocating the Kingwood Park and Ride closer to Interstate 69, at an estimated cost of up to $60 million.

Both projects were popular with respondents during Metro’s year-long public meeting process about a long-range transit plan, and also have support from local elected officials.

The Kingwood site was an obvious choice, Metro CEO Tom Lambert said, because it was affected by flooding when Tropical Storm Harvey deluged Houston. The existing site along Kingwood Drive also is time-consuming for buses to navigate, compared to a location closer to the freeway.

The Monroe rail extension, meanwhile, would provide a place for suburban residents to park and then ride the rail to various job centers.

“I think we have some conservative votes we won’t get if we don’t do it,” said Metro board member Jim Robinson, who has pressed for more investment in park and ride locations.

I have no opinion at this time about extending the rail line beyond Hobby. I’d be very interested to see what that does to the ridership projections, which to me are the most important factor. I’m also a little curious as to why this extra rail could be added at such a late date but the proposed Washington Avenue extension couldn’t be. Maybe because there was always going to be something at the one end and we were just trying to decide the details, I don’t know. I will admit to some self-interest in asking this question. Anyway, we should have the final proposition soon, and from there the real campaign can begin.

Let me start by saying that I began this post before Amanda Edwards became a candidate for Senate. I’m going to keep the AL4 race in here, in part to include Edwards’ June report totals, and in part because I’m just stubborn that way. I did add in the candidates who have jumped into AL4, so this is as up to date as I am. Feel free to tell me who I’ve missed.

I know Tiko Reynolds-Hausman and Isabel Longoria entered their races in July, so they have no reports yet. That may be true for some others as well, but if so I’m not aware of them.

Let’s get the easy ones out of the way first. Greg Travis and Martha Castex-Tatum don’t have opponents. Chris Brown, Dave Martin, and Robert Gallegos may as well not have them, either. I know, there’s still a few months to go before the election, but none of the purported challengers appear to be doing much. Heck, only Sam Cleveland even has a website, though Ryan Lee and Rick Gonzales do at least have Facebook pages. So yeah, nothing to see here.

David Robinson and Michael Kubosh have opponents who have been a bit more active – Willie Davis is a repeat candidate, having run in 2015 against Robinson – but so far don’t appear to pose too much of a threat.

The threat to Karla Cisneros is greater, and potentially severe. I’ve already seen a couple of signs for her opponents in my neighborhood, and while Isabel Longoria hasn’t had a chance to post a finance report yet, Cynthia Reyes-Revilla’s totals are OK. Not terrifying if you’re the incumbent, but not nothing. Keep this one in your back pocket, and we’ll revisit when the 30 day reports are posted.

Had Amanda Edwards decided to stay in Houston and run for re-election, I’d have grouped her with the not-really-challenged incumbents. With AL4 now an open seat, and the field likely to expand further (*checks the Manning spreadsheet one last time to make sure no one else has entered the race*), it’s also open in the sense that there’s no clear frontrunner. Nick Hellyar and Letitia Plummer, who had started out in other races, have the early fundraising lead, but not enough to present a significant obstacle. Hellyar has picked up multiple endorsements from current and former elected officials, which ought to boost his coffers, but we’ll see what that means in practice. We really don’t know anything about this race right now.

And then there’s At Large #1. If you knew nothing about this election and I told you that Raj Salhotra was the incumbent and Mike Know was a challenger, you’d believe me based on their numbers. I can’t recall the last time an incumbent was so thoroughly outclassed in this regard. That’s great for Salhotra, whose biggest challenge isn’t Knox as much as it is Georgia Provost, who nudged past four better-funded candidates as well as ultra-perennial candidate Griff Griffin to make it into the runoff in 2015. She’s going to get her share of votes, especially if the voters don’t know the other candidates on the ballot. Salhotra is well on his way to having the resources to run a sufficient citywide campaign and introduce himself to the electorate. In what should be a prelude to another runoff, he just needs to finish in the top two. So far, so good.

An update on the races in HISD and HCC

As you know, there’s been a lot of action not just in the Houston City Council races but also in the 2020 election races. That doesn’t mean things have been dull in HISD and HCC, which of course have elections this November as well. I’m going to bring you up to date on who’s doing what in HISD and HCC, which as always deserve more attention than they usually get. We will refer to the Erik Manning spreadsheet for the names, though there will be some detours and some plot twists. Settle in and let’s get started.

There are four HISD Trustees up for election this cycle: Rhonda Skillern-Jones (district II), Sergio Lira (III), Jolanda Jones (IV), and Diana Davila (VIII). Lira, running for his first full term after winning in 2017 to succeed the late Manuel Rodriguez. He has no declared opponent at this time.

Rhonda Skillern-Jones has decided to step down from HISD and is now running for HCC Trustee in District 2. That’s the district currently held by the execrable Dave Wilson. (Hold that thought for a moment.) Her jump to HCC has been known for about a week, but as yet no candidate has emerged to announce a run in HISD II. I’m sure that will happen soon.

Diana Davila is being challenged by Judith Cruz, who ran for this same seat in 2010 after Davila’s abrupt departure when she was first an HISD Trustee; Cruz lost the Juliet Stipeche, who was then defeated by Davila in a return engagement in 2015. Davila has been at the center of much of the recent chaos on the Board, especially the disputes over interim Superintendent Grenita Lathan. I would expect that to be part of this campaign.

Jolanda Jones has two challengers for what would be her second term on the Board. One is perennial candidate Larry McKinzie, the other is Matt Barnes, a career educator with some charter school experience that I’m sure won’t cause any issues at all for anyone in this election. Ahem. A possible complicating factor here (we do love complicating factors) is that there has been chatter about Jones running for City Council again, this time in District D. It’s not the first time that this possibility has arisen. To be clear, as far as I know and unlike that other time, Jolanda Jones herself has not said anything about running for Council. This is 100% speculation based on other people talking about it, which I as an irresponsible non-journalist am mentioning without bothering to check for myself. I do that in part because it allows me to dredge up the past discussion we had about whether the term limits law that existed in 2012 would have allowed Jones to run for Council again, and from there to pivot to whether the same questions apply to the updated term limits law. Jones served two two-year terms and would hypothetically be running for a third and final term, which would be for four years. Council members who were first elected in 2011, such as Jack Christie, got to serve a total of eight years via this mechanism, and because the updated term limits law that was ratified by voters in 2015 was written to exempt current Council members who were not on their third terms. Would that also cover a former Council member who had served two terms? I have no idea, but if the question became relevant, I feel confident that lawyers and courtrooms would quickly become involved, and we’d eventually get an answer. See why this was irresistible to me? Anyway, all of this is probably for nothing, but I had fun talking about it and I hope you did, too.

Now for HCC. There are three HCC Trustees whose terms are up: Zeph Capo (District 1), the aforementioned Dave Wilson (District 2), and Neeta Sane (District 7). We’ll start with Sane, whose district covers part of Fort Bend County. She is running for Fort Bend County Tax Assessor in 2020 (she had previously run for FBC Treasurer in 2006, before winning her first term on the HCC Board), and while she could run for re-election in HCC first, she appears to not be doing so. Erik’s spreadsheet has no candidate in this slot at this time.

Zeph Capo is also not running for re-election. His job with the Texas AFT will be taking him to Austin, so he is stepping down. In his place is Monica Flores Richart, who had run for HISD Trustee in my district in 2017. Capo is Richart’s campaign treasurer, so that’s all very nice and good.

And that’s where this gets complicated. Dave Wilson is the lone Trustee of these three who is running in 2019. He is not, however, running for re-election in District 2. He is instead running in District 1, where I’m guessing he thinks he’ll have a chance of winning now that the voters in District 2 are aware he’s a conservative white Republican and not a black man or the cousin of former State Rep. Ron Wilson. I’m sure Rhonda Skillern-Jones would have wiped the floor with him, but now he’s running for an open seat. He won’t have the same cover of stealth this time, though. You can help by supporting Monica Flores Richart and by making sure everyone you know knows about this race and what a turd Dave Wilson is. Don’t let him get away with this.

(Hey, remember the big legal fight over Wilson’s residency following his fluke 2013 election, and how he insisted that the warehouse he moved into was his real home? So much for that. I assume he has another warehouse to occupy, which is totally fine because our state residency laws are basically meaningless.)

Finally, while their terms are not up, there are two other HCC Trustees who are seeking other offices and thus may cause further vacancies. Eva Loredo, the trustee in District 8, has filed a designation of treasurer to run for Justice of the Peace in Precinct 6 next March, while current Board chair Carolyn Evans-Shabazz in District 4 is now a candidate for City Council District D. If Wilson loses (please, please, please) and these two win theirs we could have five new members within the next year and a half, which would be a majority of the nine-member Board. The Board would appoint replacements for Evans-Shabazz and/or Loredo if they resign following a victory in their other elections, and there would then be an election for the remainder of their terms. I will of course keep an eye on that. In the meantime, if you can fill in any of the blanks we’ve discussed here, please leave a comment.

Amanda Edwards joins the Senate race

And then there were three, with a fourth likely to follow and a fifth out there as a possibility.

Houston City Councilwoman Amanda Edwards announced Thursday morning she is running for U.S. Senate, joining an increasingly crowded primary to challenge Republican John Cornyn.

It will be a campaign against several Democratic rivals and, possibly, a three-term incumbent whose reelection war chest tops $9 million. But should Edwards win, she would be the first African American Texan to serve in the U.S. Senate.

“As a woman, as an African American, as a millennial — and in certainly as someone who generally … believes in solutions and not just rhetoric — I think I’m going to be the candidate that can do the job,” she said in an interview with The Texas Tribune, emphasizing the need for a nominee who can persuade voters to vote Democratic but also “galvanize our base.”

Edwards, who had been considering a run since at least March, is finishing her first term as an at-large City Council member after being elected in 2015. She said she does not plan to run for a second term in November but will serve out her term, which ends in December.

Edwards launched her bid with a video, set to drum-line music, that reflected on her family’s middle-class struggles and highlighted a key part of her council tenure — the Hurricane Harvey recovery. Over images of Martin Luther King Jr. and Ann Richards, Edwards appealed to “all of the people who have ever been locked out or told that they can’t wait or to wait their turn because the status quo or establishment was not ready for change.”

So far, Cornyn’s most serious Democratic challenger has been MJ Hegar, the 2018 U.S. House candidate and retired Air Force helicopter pilot. She launched her bid in late April and raised over $1 million through the second quarter.

Since then, another Democrat, Chris Bell, the former Houston congressman and 2006 gubernatorial nominee, has entered the primary, and some progressive operatives have mobilized to try to draft top Latina organizer Cristina Tzintzún Ramirez into the race.

As the story notes, State Sen. Royce West is set to make an announcement on Monday, which is widely expected to be his own entrance into the race. If Edwards’ announcement, which I at least wasn’t expecting, was intended to steal some of West’s thunder, then kudos to her for doing so. I admit I’d been skeptical about Edwards’ intentions, as there had been a lot of “Edwards is considering” mentions in other stories but very few direct reports about her, but here she is.

Edwards anticipates raising $5 million for the primary, and “potentially you’re looking at several million dollars” for the general election, she said. Over and over, she stressed that the Senate race could be nationalized.

“I think with the general, however, this will be a national phenomenon because people will recognize Texas is such a key piece” to changing the direction of the country, she said.

She told the Tribune that she has met with U.S. Senate Minority Leader Chuck Schumer — as did Hegar and West — and had “very, very positive discussions” with him and the Senate Democratic campaign arm. She suggested another heavyweight group, EMILY’s List, which works to elect Democratic women who support abortion rights, is “very much looking at this and looking to get involved in this race.”

“I think they’re very, very excited to see Texas flip, and they’re going to spend resources” to make it happen, Edwards said of national Democrats’ interest in the race.

I imagine EMILY’s List is happy with these developments, though now they’ll either have to pick a favorite among the female candidates or wait till one of them (hopefully) wins and then get involved. As for Edwards, five million is a decent sum for the primary, but the target for November has to be a lot higher than that. John Cornyn is not going to be outraised like Ted Cruz was.

One more thing, from the Chron:

Though she began mulling a run for Senate months ago, Edwards waited to join the race until city council approved Houston’s budget for the fiscal year that began July 1. Edwards serves as vice chair of the city budget committee and helmed several department budget workshops in chairman Dave Martin’s absence.

Edwards’ city campaign account had about $193,000 cash on hand through the end of June. She cannot transfer the money to her Senate campaign, though she may send unspent campaign funds back to donors and ask them to re-contribute.

That helps explain the timeline. With Edwards not running for re-election, the At Large #4 seat is now open, the eighth open seat on Council this election, joining Districts A, B, C, D (for now, at least), F, J, and At Large #5. The impact has already been felt in the field of candidates for AL4. There were four challengers at the start of the week – Christel Bastida, Tiko Reynolds-Hausman, Ericka McCrutcheon, and Jason Rowe – and now there are six, with Nick Hellyar moving over from District C and Letitia Plummer swapping out from AL5. Don’t be surprised if that field grows further, too. We live in exciting times. The DMN has more.

July 2019 campaign finance reports: Mayoral candidates

All right, now that we are past the 15th, most of the campaign finance reports are in, so let’s start reviewing them. Because there are several thousand candidates running for office in Houston, I’m going to split them into several groups. We’ll begin with the Mayoral candidates and go from there. As a reminder, my look at the January 2019 finance reports for Houston candidates is here, and all of the finance reports that I have downloaded and reviewed are in this Google folder. I’ll be going by Erik Manning’s invaluable spreadsheet, which lists the following Mayoral hopefuls:

Sue Lovell didn’t enter the race until this month, so she does not have a report yet. The others are I presume typical fringe candidates who have no idea what they’re doing. Place your bets as to how many of them actually file by the deadline.

Sylvester Turner is doing what you’d expect. Given that he’s running against someone who’s willing to set large bags of his own money on fire for this race, it’s possible he’ll step it up even further for the next report, but it’s hard to complain about what he’s done so far. As for Buzbee, who made two contributions worth $5.5 million to his campaign this cycle after dropping $2 million before January, I guess this is what you do when you have more money than brains and all your toys bore you. He’s the only contributor to his campaign, by design. I almost feel sorry for Bill King, who doesn’t have Buzbee’s moolah or Turner’s base. He’s going to have a hard time keeping up.

And then there’s Dwight Boykins. I don’t know what I expected from Boykins’ July report, but here’s a fun fact for you: Boykins reported raising $150K in his July 2013 finance report, when he was running for his first term in District D. You may note that the “Office Sought” field on Boykins’ current finance report is blank. I’m not saying that Boykins may change his mind before the filing deadline and run for another term in his current office, but I’m not not saying it, either.

Finally, out of sheer curiosity, I also looked at the report of the End Pay to Play PAC, the vehicle by which Bill King failed to put a campaign finance referendum on the ballot. End Pay to Play raised $95K, of which $20K came from King, $20K came from Nijad Fares, $10K came from Hartman Advisors LLC, $5K came from JBK Family Interests Ltd, and there were five other $5K donors. Not exactly a grassroots uprising. It spent $130K, thus leaving about $41K in “unpaid incurred obligations”, with most of the spending going to an outfit called Election Day Strategies in Corpus Christi. And now it sinks from sight, a minor footnote in this busy year.

Here’s some Chron coverage on the reports so far. I’ll start looking at the Council candidates, along with other races. There’s no shortage of these posts to do. As always, let me know what you think.

Here come the youths

There are a lot of younger candidates running for Houston City Council this year.

Inspired by the recent electoral success of millennial and Generation Z-aged candidates, more young people are running for Houston city council than ever before, a trend local politicos attribute to the potent national surge of activism stemming largely from President Trump’s election in 2016.

In last year’s midterm election, many of those new, young activists ran for office and won. Since the election, 29-year-old U.S. Rep. Alexandria Ocasio-Cortez has become one of the Democratic Party’s most prominent voices, while locally 28-year-old Harris County Judge Lina Hidalgo has led a dramatic political shift on Commissioners Court, which flipped to Democratic control for the first time in decades.

“I think we have to acknowledge the success in the 2018 cycle of millennials and very young candidates,” said education consultant Jay Aiyer, who served as former Mayor Lee Brown’s chief of staff at age 29.

A handful of candidates younger than 30, and at least a dozen more in their 30s, are seeking seats this year on Houston city council, the legislative body for the country’s fourth-largest city. Though council members have little formal power in Houston’s strong-mayor form of government, they approve an annual city budget north of $5 billion and handle constituent services for districts comprised of around 200,000 residents.

Among the youngest contenders are 18-year-old Marcel McClinton, a shooting survivor-turned-activist running for one of five at-large positions; 21-year-old Anthony Dolcefino, a candidate for District C; 24-year-old District D candidate Dennis Griffin; and 29-year-old Anthony Nelson, a Prairie View A&M University student running for District F.

Raj Salhotra, 28, is one of three candidates challenging At-Large 1 Councilman Mike Knox, a former police officer who is seeking a second four-year term. Also running are Michelle Bonton and Georgia Provost.

Salhotra is calling for the city to offer universal prekindergarten and more public transit, enforce more regulations on “pollutant-emitting plants” and require all new city vehicles be hybrid or electric.

Meanwhile, Knox repeatedly has pushed for the city to rein in what he calls “frivolous spending,” and to focus on core services — public safety, infrastructure, trash pickup — before thinking about anything else.

“The citizens of Houston want our government to spend money wisely and efficiently, and get the biggest bang for our buck,” Knox said. “My votes are designed to help the city stop its overspending habits and get back to focusing on our core responsibilities, and thereby staying within our means.”

Salhotra criticized Knox for, among other things, voting not to join a lawsuit challenging Texas’ anti-“sanctuary cities” law, and called Knox “really out of step with what the vast majority of Houstonians believe in.” Salhotra’s own policy views, he said, are rooted partly in his age.

“I think a lot about, how are the policies we put in place today affecting the next 30, 40, 50 years in Houston?” Salhotra said. “Because I’m going to be living here for the next 60 years of my life, God willing.”

The race for District C, which includes Montrose, Meyerland and Braeswood, has emerged as the most crowded contest: Thirteen people are running to succeed Cohen, who recently endorsed 32-year-old Abbie Kamin. Other candidates include Candelario Cervantez, 36, Nick Hellyar, 38, and the 21-year-old Dolcefino, son of former KTRK reporter Wayne Dolcefino.

“We’re living in a serious time, we’re at a critical juncture in this city, and certainly in the country, and it’s going to take everyone to be active and fighting — of all age groups,” Kamin said.

As is always the case, some of these candidates are more serious than others, and thus more likely to succeed than others. I’m starting to look through the campaign finance reports, which will give one indicator of how these and other candidates are doing. Turn your nose up however you like at the notion of fundraising being a proxy for candidate seriousness, the fact remains that it’s hard to get elected if no one knows who you are, and getting your name into the minds of voters doesn’t happen by magic or wishful thinking. It costs money to run a campaign, and that money has to come from somewhere.

Be that as it may, there’s another dynamic at play here that needs to be discussed. Historically speaking, at least, the voters in our city elections are old. How old? Here’s some research I did in 2015, which I’m just going to reprint here, as I think the numbers speak for themselves:

So yeah, when between two-thirds and three-fourths of your voters are over the age of 50 (a group that includes me now), it’s going to be that much more of a challenge for 20-something and even 30-something candidates to be taken seriously. It can be done – judging by the year of her college graduation as shown on her LinkedIn page, CM Amanda Edwards was 33 when she was elected in 2015 – but it’s a hurdle that older candidates don’t face. Let me know when someone writes a story about that.

Now of course, this calculus can be changed to some extent by simply getting more young voters to the polls. I don’t have the data for 2018, but there’s plenty of evidence nationally that younger voters were a larger part of that electorate than they were in 2016, and much more so than in 2014. That only goes so far, of course – there are only so many people between the ages of 18 and 40, let alone registered voters, let alone actual voters – and turning them out at a higher rate is much, much easier said than done. Perhaps some of the 2018 energy will carry over – I’d expect it to have some effect, though not much – but the fact remains that the regular, reliable voters are the ones who largely determine these elections. That’s the task all of these candidates, of any age, have before them. Good luck.

“Pay to play” petition drive falls short

Womp womp.

The political action committee that launched a petition drive aimed at limiting the influence of contractors and vendors at Houston City Hall failed to gather enough signatures to put the measure on the November ballot, the group’s director said Wednesday.

The drive, which ended earlier this week, was for a petition authored by a group of lawyers, including Houston mayoral candidate Bill King, to amend a city ordinance to bar people who do business with the city from contributing more than $500 to candidates for municipal office.

Mayor Sylvester Turner, who has rejected calls from King and fellow candidate Tony Buzbee to reform Houston’s campaign finance system, suggested the effort’s failure was an indictment on the “anti-pay-to-play” message being pushed by the political action committee backing the petition. The mayor urged reporters to “focus on real issues, real needs.”

“Let me just put it this way: I have not seen any problems,” Turner said. “I think that whole movement was more political than substantive.”

Ben McPhaul, the director of the PAC, said the committee still was receiving petitions Wednesday but would fall short of the roughly 40,000 signatures it needed to gather in 30 days under city rules.

“We are grateful for the hundreds of grass-roots volunteers who helped the effort with not a single paid petitioner,” McPhaul said in a statement. “The PAC plans to continue collecting signatures to raise awareness of the issue with hopes to get it on the ballot or in front of council in the future.”

See here for the background. Just so we’re clear here, this is not City Secretary Anna Russell counting the signatures and saying they don’t have enough valid ones. This is the PAC itself saying they didn’t get enough to even submit for inspection. They fell short of their goal.

The petition drive’s failure reflects the PAC’s lack of volunteers and funds more than the public’s interest in reforming Houston’s campaign finance reform system, Rice University political scientist Mark Jones said.

“You can’t read anything into this regarding the attitudes of Houstonians toward ‘pay to play,’” Jones said.

Still, the outcome represents a win for Turner, Jones said, because it means the topic of campaign finance reform may gain less media coverage and traction from political pundits near election time.

“I wouldn’t put it as a major failure for King, but certainly it’s a setback,” Jones said. “Once he got behind the petition, he owned the petition.”

King said state law separately allows a longer period for petition drives, so the PAC would continue to collect signatures. Though King’s campaign is not affiliated with the PAC, it has supported the drive, and King made a point of being the first person to sign the petition.

“We’ve been carrying it around on our campaign and we haven’t had a single person refuse to sign it,” he said.

He also noted Houston’s charter bases the number of required petition signatures on a mayoral election held within the last three years. Since the last election happened in 2015 — more than three years ago — King contended a petition drive now technically needs just one signature.

If that were challenged in court, however, the litigation would get resolved well after November, said King, indicating he had no interest in taking action in court.

I can accept that this isn’t a “major failure” for Bill King, but it should be clear to everyone that he didn’t put any real effort into this cynical ploy. He has plenty of his own money, and could have raised more, to fund a sufficient petition drive if he really wanted this to be on the ballot. We’ve seen plenty of successful petition drives in the last decade. Did King really not know what it was going to take, or did someone tell him and he was like “eh, whatever, we’ll just wing it with some volunteers”? If “cleaning up City Hall” is the foundation of your campaign, and you go through the motions to mount this effort in the first place, what does it say about you and your commitment to this idea that you just let it fail without a fight?

The bit about the charter language is interesting. I think as a legal argument it’s mostly sophistry, but I could see a judge buying a plain-text reading and agreeing that even one signature is now sufficient until and unless the city cleans up that part of the charter. Here again, though, if King actually believed what he was saying he would have acted differently. Why not file that lawsuit before now? Theoretically, he could have filed it on November 4, 2018, which is three years and a day after the 2015 Mayoral election. Even if I’m wrong about that, I don’t see anything in the charter section on legislating by referendum that limits when a petition effort is allowed to begin. Maybe there still wasn’t a path to getting the question resolved in time for the 2019 election – though if you win the first round, it’s the city that has to start worrying about deadlines, not you – but boy howdy was this a limp production. It’s easy for me to take potshots at Bill King, but if you like him as a candidate and believed in this proposed charter amendment, you should be upset. At every step of the way, he did the very least he could do.

Royce West looks ready to announce

Royce West is one step closer to running against Republican incumbent Sen. John Cornym.

The Dallas Democrat has announced a news conference for July 22, where he’s widely expected to launch a campaign for Senate. The longtime state senator would join a Democratic Party primary that already includes former Air Force helicopter pilot MJ Hegar of Round Rock and former U.S. Rep. Chris Bell of Houston. And Houston council member Amanda Edwards is considering mounting a campaign as well.

West, 66, has hinted at a campaign against Cornyn for months, but has not officially gotten into the race.

He’ll make an announcement at 10 a.m., July 22 and Democratic Party headquarters in Dallas, according to a sign-up link on a website he’s developed for the occasion.

West has represented Texas Senate District 23 since 1993. He’s also a prominent Dallas attorney and one of the leading Democratic Party voices in the state.

See here and here for the background. As the story notes, the field now includes Chris Bell, with Amanda Edwards still on the periphery. I don’t know what if any timetable Edwards has beyond the late August filing deadline for Houston races, but I do know that another candidate for Edwards’ Council seat has emerged (*), so perhaps the consensus opinion is that this is about to be an open seat. My guess is that with West more or less formally in, we’ll hear something one way or the other from Edwards soon. But I’ve also been guessing that for awhile now, so take it with a sufficient quantity of salt.

(*) In the spirit of disclosure, AL #4 candidate Tiko Reynolds-Hausman is a friend of mine. I’ve served on two PTA boards with her, and her daughter and our elder daughter have been classmates and friends for years.

A look at the Constitutional amendments we will see this November

There are ten of them, including a couple I will vote against as hard as I can.

House Joint Resolution 4 would let the Texas Water Development dole out dollars from a flood infrastructure fund — created by Senate Bill 7, which would spend $1.7 billion from the rainy day fund — to be used for planning, seeking permits for or constructing flood-related projects. SB 7 is awaiting Gov. Greg Abbott’s signature.

If approved by voters, the flood infrastructure fund would be created at the start of next year.

HJR 34 would let the Legislature temporarily lower tax rates on property damaged during a disaster declared by the governor. House Bill 492 would set the initial tax exemption rates, up to a full exemption, according to the extent of the damage.

HJR 38 would ban the creation of a state income tax, doubling down on a constitutional amendment approved by voters in 1993 that requires voters’ permission for the Legislature to create a state income tax.

HJR 95 creates a tax exemption for precious metals held in the Texas Bullion Depository, which opened in North Austin in June 2018 with its permanent location in Leander expected to open in December.

While that depository made Texas the only state to have a state-operated depository, HJR 95 author Rep. Giovanni Capriglione, R-Southlake, said it is at a competitive disadvantage because it is also the only state allowing local property taxes on precious metals.

HJR 72 intends to ease the pressure put on smaller communities to find municipal judges by allowing one person to be elected to multiple cities’ judgeships. Currently a person can only hold multiple municipal judgeships by being appointed to each one.

Senate Joint Resolution 32 would let police dogs and other law enforcement animals retire in their old age to live with their handler or other caretaker. The state constitution currently prevents law enforcement from transferring valuable property to a private person or organization for free.

The other four are HJR12, HJR151, SJR24, and SJR79, all of which are financial in nature. As you know, I’m going to cast an enthusiastic but almost certainly futile vote against HJ38, the double secret illegal anti-income tax proposition. HJR95 also looks ridiculous to me – the whole Texas Bullion Depository thing is ridiculous, so it comes with the territory, while HJR72 and SJR32 seem reasonable. The rest I’ll figure out later. The ballot wording should be set in August. What do you think about these?

Two Geto Boys are better than one

Again I say, sure, why not.

William James Dennis, a rapper who goes by the stage name Willie D, has filed a campaign treasurer’s report to run for city council, becoming the second member of the Houston-based hip-hop group Geto Boys to seek a council seat.

Dennis filed a report Thursday with the city secretary’s office indicating he will run for District B, joining a field of 11 candidates.

Councilman Jerry Davis represents the district, but he has served the maximum number of terms and cannot run for reelection.

Hilton Koch, a Houston furniture dealer who is serving as campaign treasurer, confirmed Monday that Dennis is seeking the District B seat.

It is unclear, however, whether Dennis legally can be a candidate for council because he is a convicted felon.

The other candidates in the District B race are Robin Anderson, Cynthia Bailey, Patricia Bourgeois, Alvin Byrd, Karen Kossie-Chernyshev, Tarsha Jackson, James Joseph, Alyson Quintana, Renee Jefferson Smith, Ben White Jr. and Huey Wilson.

As the story notes, fellow Geto Boy Scarface is in for District D, the seat vacated by Dwight Boykins (assuming there are no backsies), where he currently faces a smaller field. I don’t know how Dennis’ past conviction will affect his candidacy, but having a conviction appears to have discouraged Booker T from running for Mayor (to be sure, there may well be other reasons why he hasn’t followed through on that). My opinion is that if you have completed your sentence you should be free and clear, but as far as I know that proposition has not been tested in the courts. So we’ll see. In the meantime, I will note that I am most familiar with District B candidates Alvin Byrd, who lost in the runoff to incumbent Jerry Davis in 2011, and Tarsha Jackson from her time with the Texas Organizing Project. Cynthia Bailey has sent out the most campaign emails, at least among candidates who have bought email lists that include mine.

CM Steve Le not running for re-election

We have another open seat, in District F.

Steve Le

Houston City Councilman Steve Le announced Wednesday he will not seek a second term in November, leaving an open race for his District F seat and ensuring the southwestern district will get a new representative for the fourth straight election.

Le, a physician who practices in Cleveland, narrowly defeated incumbent Richard Nguyen in 2015, winning a runoff by about 230 votes, or 3 percentage points. He had drawn five opponents — including Nguyen — before deciding not to run again.

Le was seen as one of the most vulnerable incumbent council members seeking re-election.

Citing questions and a city investigation into the work habits and time cards of his former chief of staff, Daniel Albert, constituents and neighborhood leaders had called on Le to fire Albert and resign his seat.

Le also faced residency questions upon taking office, as he had more formal links to a home in Kingwood than to the district address he listed in Alief. His business was registered at the Kingwood property, he was one of five people listed on the deed of trust for the property, and he, at the time, registered three of his four vehicles at that address.

Le did not return calls for comment Wednesday. In a statement to KPRC, he said he plans to return to his medical practice, and pointed to several accomplishments, contending the district’s infrastructure improved during his tenure.

“My goal when running for election was to work with the mayor and current council to implement changes that would benefit the residents of Houston, be fiscally responsible with our budget, improve street and drainage conditions of District F, (and) increase public safety,” the statement said.

In addition to Nguyen, candidates Anthony Nelson, John Nguyen, Tiffany Thomas and Jesus Zamora are seeking to represent the southwest Houston district that covers parts of Alief, Eldridge-West Oaks, Sharpstown and Westchase.

Van Huynh, Le’s chief of staff, said Wednesday he, too, will run for the seat, and has filed a report with the city secretary’s office designating a campaign treasurer.

See here for some background; Le did eventually fire Albert. To be sure, other District F Council members have had questions about their residency before, including MJ Khan and Al Hoang. For whatever the reason, that does not seem to be an obstacle to getting elected in F. Someone can correct me if I’m wrong, but I think Le is the first member of Council to not run for re-election when able to do so since Peter Brown ran for Mayor instead of a third term in At Large #1 in 2009. Chris Bell did the same thing in 2001. Off the top of my head, I can’t think of a recent Council member who stepped down without running for something else. Feel free to fill in the blank if you can.

As always, you can see an up-to-date list of candidates in Erik Manning’s spreadsheet. I guess I need to get an Election 2019 page going, as June finance reports will be coming in. As for the cast in District F, I know Tiffany Thomas and former CM Richard Nguyen; I’m Facebook friends with Anthony Nelson but haven’t met him. Le’s departure may lead to more candidates entering, but if there’s one thing this election has not lacked, it’s candidates.

Houston city councilman and mayoral candidate Dwight Boykins is facing backlash for a recent incident in which he allegedly advised a group of students to “keep their legs closed,” among other comments that some attendees said made them feel uncomfortable.

The District D councilman’s remarks came Friday afternoon during a “youth advocacy summit,” where Boykins and Mayor Sylvester Turner separately addressed middle and high school students about getting civically engaged.

While talking to a roomful of teenagers, Boykins told the students to “keep their legs closed” and joked about dating one of them, according to accounts from multiple students.

In a statement issued Monday, Boykins said he was asked to offer the students “words of inspiration” and “help them understand the important role they play in our future.” He said he intended to “speak frankly about the pitfalls which I have seen derail the future of many of our youth, including teen pregnancy…an issue I have firsthand experience with in my own family.”

An invitation to Boykins, released to reporters Monday, shows he was invited to talk about his personal story, time as a council member and why he is running for office, while Turner was invited to hold an “intimate conversation” on mental health, criminal justice and other policy topics.

Many of the students were “eager to make a difference in the 2019 Mayoral election” and encouraged to volunteer on campaigns, the invitation reads.

In an audio recording of a segment of the event, a female student can be heard confronting Boykins about his comments.

“You’ve made some comments that have made me a little bit uncomfortable. You’ve joked about dating some of us,” the student said.

“Not dating you. I mean, that was an example,” Boykins interjected.

“You’ve pulled and singled out a few of the girls, you’ve told us to keep our legs closed,” the student continued, also alleging that Boykins “didn’t really answer” a question about gender equality.

Boykins responded by apologizing and insisting that he did not intend to make the group uncomfortable.

“That’s really important for me to know that you understand, it wasn’t personal,” Boykins said. “It was trying to warn you guys what’s out there.”

One female student described the room as being “tense, but people were afraid to say something.”

In a second statement Monday, Boykins said “a few seconds” of his talk “overshadowed my entire conversation which was meant to ensure that our youth have the best opportunity to succeed in life.”

Sue Lovell announces for Mayor

Former Houston city councilwoman Sue Lovell announced Monday she is running for mayor, becoming the fourth major candidate aiming to deny Mayor Sylvester Turner a second term in November.

Lovell made the announcement in a news release posted on her campaign website. She joins a field that includes District D Councilman Dwight Boykins, trial lawyer Tony Buzbee, businessman Bill King and at least five lesser-known candidates.

In her announcement, Lovell emphasized her tenure as chair of the city council transportation committee and advocacy for LGBTQ rights. She served three terms on council from 2006 to 2012, including a stint as vice mayor pro-tem.

“Now, more than ever, our citizens trust that public safety will be a priority, that the services they pay for will be delivered efficiently and on time, and that there will be an investment in the city’s infrastructure and their quality of life,” Lovell said in a statement. “I will honor that trust and deliver on those commitments.”

Speculation had abounded for months that Lovell would join the race, representing a challenge to Turner from his left. Lovell also has established herself as an ally to the Houston Professional Fire Fighters Association, working for a political action committee that supported Proposition B during last year’s midterm election.

That’s what this is about. It makes me wonder if the firefighters, who had previously endorsed Dwight Boykins before he stepped in it over the weekend, might reconsider their options. Or maybe the two of them will split the pool of pro-firefighter/anti-Turner Democrat voters. I don’t know.

Though Lovell’s name last appeared on the city ballot in 2009, she has remained visible in the community for the last decade and likely maintains some recognition among voters, said Brandon Rottinghaus, a political science professor at the University of Houston.

“She’s been out office for awhile, but there are still a lot of people that know and respect her,” Rottinghaus said.

Lovell is likely to cut into the mayor’s progressive base, said Mark Jones, a political science professor at Rice University. Before Lovell joined the race, Jones said, “Turner was going to be the preferred choice of most liberal Anglos.” Those voters are more likely to support Lovell than King, Buzbee or Boykins, Jones said.

Yeah, but she was always an underperformer at the ballot box. In 2007, running for her first re-election, she failed to crack 53% against perennial candidate Griff Griffin. In 2009, she was forced into a runoff against perennial candidate Andrew Burks. I happen to think Lovell was a fine Council member and a master of policy details, but she tends to burn bridges and accumulate enemies. I’ll be very interested to see what kind of endorsements she gets, and what her fundraising is; we won’t know that till the 30 day reports, as that is the advantage of announcing one’s candidacy on July 1.

A preview of the joint primary

Like Campos and John Coby, I recently had the opportunity to visit the Harris County Clerk and get a preview of the proposed joint primary. Coby describes it in some detail, with pictures, so I won’t duplicate his effort. Basically, the process will be very much like what you are used to already. The main difference in terms of the experience is that instead of telling the poll worker what primary you want to vote in, you pick it from a touch-screen tablet. Otherwise, it’s exactly what you’ve done before – you show your ID and sign in, you get a code for one of the eSlate machines, and you go vote. That’s all there is to it. The practical effect is that now all of the machines are available to you. There aren’t machines designated for one primary or the other, so if you’re voting at a location that historically has a long line for one party with idle machines for the other, that will no longer happen. This should help the lines move more efficiently, which in a year where a very high turnout is expected on the Dem side is greatly appreciated.

Primaries are run by the parties, and the initial reaction to this was positive from the HCDP and negative from the Harris County Republican Party. We were told at this visit that both Dem Chair Lillie Schechter and GOP Chair Paul Simpson had been in to see the same setup, and it went well. Simpson is supposedly going to make a decision about this in the next two to three weeks. I asked about the experience other counties have had with joint primaries. Michael Winn, the elections administrator who came from Travis County, said they made the change in 2011 and haven’t looked back. We’ll see.

We also discussed how election night returns are reported, which was a concern in the May election after the switchover to voting centers. We’re used to seeing reports come in by precinct, but with anyone being able to vote anywhere now that’s going to be a different experience. They’re working on that now so as to provide a better picture of where the vote totals are coming from, and they promised a preview for interested parties (campaigns, media, etc) in October. I’ll report back then. In the meantime, I have a good feeling about how this is going. Let me know if you have any questions.

Several Sugar Land families say they’re stunned and upset with how city council member and mayoral candidate Dwight Boykins addressed a room of teenagers Friday, even starting a hashtag #BoycottBoykins.

ABC13 Eyewitness News spoke with several teenagers who were attendees of a five-day Youth Advocacy Summit organized by OCA Asian Pacific American Advocates and Mi Familia Vota.

The night was billed as a meet and greet conversation for area youth to hear from Boykins.

“Initially, we were really excited because we didn’t know much about this mayoral candidate,” said 17-year-old Hajra Alvi.

But Hajra and her friends say the question-answer session with Boykins went south very quickly.

“He was telling us we should keep our legs closed, that we shouldn’t taint ourselves,” said 16-year-old Khloe. “In a way, saying that we should stay pure because otherwise, in the future, other men won’t want us.”

The attendees say Boykins grabbed another teen girl from the audience to demonstrate a relationship.

“He made a young man stand up and he was holding another girl side by side and he was like, ‘If me and her were to do something, that young man wouldn’t want you in the future,’ and that really shows that he is invalidating young girls and not putting a good message across to the youth of America,” said Khloe.

“I was actually sitting like right across from her so I could see her expression perfectly and I could see her looking at everyone else and sort of mouthing, ‘I want to leave’,” said Hajra.

This was first reported on Instagram here, with some video of the interaction with the young girl here. Hajra Alvi, who was quoted in that KTRK story, also posted to Instagram about it, and you can see her post in this Twitter thread. OCA Houston and Mi Familia Vota, who organized the event, released a statement condemning Boykins for his actions, while Boykins posted his own statement, which got a better reception on Facebook than it did on Twitter. It’s a generic apology, so if you have no idea what he’s talking about it doesn’t sound like any big deal. But it is – it’s straight up purity culture slut shaming, and it really, really has no place in today’s discourse.

Let’s talk about what Boykins should do at this point, because one of the many things that the #MeToo era has made clear is that lots and lots of people have no idea how to offer an appropriate apology.

1. Fully admit to the thing that you did that you are now apologizing for. Don’t euphemize, don’t analogize, don’t avoid the facts, and for crying out loud don’t praise yourself for your past actions or pure-hearted intentions. You don’t have to beat yourself up, just state the plain facts.

2. Make it clear that you understand why the thing that you did is wrong and why it harmed someone else. You can’t make amends if you don’t know what you’re making amends for.

3. State what you will do differently going forward, and if needed what you will do to make it up to the people who were harmed. Again, this is not the time or the place to state your credentials as One Of The Good Ones, or whatever mitigating factor you think should let you slide on this. This is about your actions.

4. Say you are sorry to those you harmed. Not to those “who may have been offended”, or “who may have misunderstood” what you said or did, because those are weasel words. You did something harmful. You are sorry you did this. Say that.

None of this is easy. I speak from the experience of having to apologize for all kids of dumb, hurtful, spiteful, mean-spirited, ignorant, and offensive behavior in my own life. I still get it wrong. But it’s the only way.

Anyway. I don’t support Boykins’ Mayoral candidacy, and he has no reason to care what I say. I hope he does make a full and sincere apology anyway, not because I care about his candidacy but because the girls who were there and experienced what he said deserve it. I’m not voting for him either way, but I’ll respect him a lot more as a person if he does the right thing.

Metro and the Mayor’s race

This went pretty much as one would expect.

Delivering his fourth State of Mobility speech to Transportation Advocacy Group-Houston Chapter, Mayor Sylvester Turner echoed previous years, noting the region needs more options than solo driving if it is to handle the deluge of new residents in the future.

“We need to find ways to move people efficiently and quickly, and that means more than just building more highways,” Turner said.

While touching on the many improvements needed in the region, including deepening the Houston Ship Channel to keep the Port of Houston an attractive call for ships and support of a high-speed rail line from Houston to Dallas, much of the session was spent on the upcoming transit plans.

“We cannot continue to operate a transportation system as if it was 30 years ago,” Turner said.

“Given the congestion we have now… we must build out our system,” Metro Chairwoman Carrin Patman said.

Patman and others said most of the summer will be spent selling voters on the plan, though officials believe it has strong support.

“Of course, we will have some naysayers,” Patman said.

That includes some of Turner’s opponents in the mayoral race, which also will be on the November ballot. Bill King and Tony Buzbee both have said Houston has invested too much in public transit to the detriment of suburban commuters.

Asked during a June 10 Kingwood forum on transportation solutions, King said “it is not transit or light rail” while congratulating Metro on its commuter bus efforts.

Buzbee focused his remarks at the event on the need to improve neighborhood streets and synchronizing traffic lights for better efficiency. He called the Metro plan too focused on a small portion of the city.

“It is more about career politicians telling us public transit is good,” Buzbee said.

So, Bill King cares more about people driving in from The Woodlands than anything else, while Buzbee demonstrates zero grasp of the topic at hand. As for Dwight Boykins, he wasn’t quoted in the story, probably because he wasn’t at the event. Insert shrug emoji here.

Look, Metro has come a long way since the dark days of Frank Wilson and David Wolff. There are more HOV lanes, a vastly improved bus system, more light rail, good ridership numbers, and forward-thinking planning from the Board and the Chair. All that is at risk, not just with the MetroNext plan on the ballot but also Mayor’s race. All the good work being done goes right out the window if a transit-hostile or transit-ignorant Mayor gets elected. Sylvester Turner is the only choice if you care about transit. It’s not even close.

Maybe rural counties don’t want hospitals

That’s what the evidence says.

The voters of Fayette County have spoken, and they’ve said that they don’t need a hospital in this rural community of 322,000 people, one hour southeast of Austin — or at least not enough to pay for it. In a landslide vote Thursday night, county residents overwhelmingly rejected a proposition to create a taxing district for St. Mark’s Medical Center in La Grange, which would have kept the deeply indebted hospital open for the foreseeable future. As the polls closed, it was clear that the idea of propping up the institution with public money didn’t have a snowball’s chance in Central Texas. The final tally was 1,360 for, 5,600 against.

“I’m very proud of the grassroots effort that stood against the taxes,” Deborah Frank, the chair of Fayette County’s Republican Party and a member of Concerned Taxpayers of Fayette County PAC, told the Observer Friday. Her group swiftly mobilized an opposition campaign against the proposition after it was put on the ballot in April, holding public meetings and distributing yard signs reading “NO NEW TAXES.” Their message: People here are already taxed enough and shouldn’t be forced to bail out a private institution simply because it’s made what they see as bad financial decisions.

Voters apparently took the message to heart.

The resounding loss is expected to push the 65-bed hospital, which is at least $14 million in debt, even closer to financial collapse. And it comes at a time when the headwinds against rural hospitals in Texas are especially strong.

Across the state, roughly 20 rural hospitals have shuttered since 2013 — casualties of low patient volumes, stingy Medicaid and Medicare reimbursement rates, and the burden of operating in Texas, which has more uninsured people than any other state. Seventy-five more are at risk of closing down.

One point to note: I have no idea where that “rural community of 322,000 people” figure comes from. Fayette County had 24,554 people as of the 2010 Census, and while it’s been growing over the past few decades, I’m pretty sure it hasn’t grown that much since then. I don’t live in La Grange and I don’t know anything about St. Mark’s Medical Center, so maybe it was a fiscally sound decision to not try to prop it up with a taxing district. I do know that if I lived in La Grange and faced the prospect having to travel 20 miles to Smithville or 26 miles the other direction to Columbus to find an emergency room, I’d be a little concerned about the risks to my health going forward. But hey, at least their taxes won’t go up.

Buzbee billboard lawsuit dismissed

I did say it was a dumb lawsuit.

A state district judge has dismissed challenger Tony Buzbee’s lawsuit against Mayor Sylvester Turner and advertising company Clear Channel Outdoor over a series of billboards for the city’s AlertHouston campaign.

In the suit, Buzbee claimed Clear Channel and Turner had conspired to support the mayor’s re-election bid by “promoting him as a civic-minded safety conscious leader” on the ad campaign for a system that sends alerts to Houston residents during emergency situations.

The advertisements, which were taken down earlier this month, featured a photo of Turner next to the words “Be Prepared. Be Safe. Be Alert Houston.”

Buzbee, a trial lawyer, said in a statement Tuesday that he plans to appeal the ruling, which was issued last Friday by 281st District Judge Christine Weems.

Weems did not explain the dismissal in her ruling, writing only that Turner and Clear Channel had 21 days to set a hearing or file a motion to determine how much they would be reimbursed for attorney fees and other costs.

See here for the background. The billboards were taken down, which is what Buzbee wanted, though the Turner campaign says they were going to be coming down around this time anyway. The motion to dismiss was filed by the defendants, so in that sense Buzbee lost, and unless the suit is reinstated he’ll be on the hook for court costs and attorney fees. Metro still talking how to get to Hobby

At some point, we gotta make a final call.

Transit and city officials took turns Tuesday trading barbs over the best way to route light rail from Houston’s East End to Hobby Airport.

In a sometimes-testy back and forth, District I Councilman Robert Gallegos and Metropolitan Transit Authority Chairwoman Carrin Patman sparred over various scenarios to route rail from the Green Line’s terminus along Harrisburg near 75th to Hobby.

“You are destroying the East End and I am letting you know now I will not support it,” Gallegos said of one plan that would use 75th Street. “If you are going to do this, do it right.”

Patman later fired back that transit officials had gone out of their way to address the concerns, but some compromise was required.

“I have tried to draw them and it has blown up in my face,” Patman said of efforts to find alternatives.

There are a lot of considerations to balance, including how much property would need to be taken, what ridership numbers might look like, and how to connect to employment centers. There’s no solution that satisfies everyone, but Metro wants the best plan it can get that will not lose votes for the overall project. I wish them luck.

As rail in the East End remains under review, officials cooled on proposed plans for light rail along Washington Avenue to Heights. The proposal, advocated by the Houston Downtown Management District, would have extended rail service from Houston’s municipal courthouse near Memorial Parkway and Houston Avenue farther west, mostly via Washington Avenue.

The idea generated wide support among transit advocates, but Patman said it may be too late to add more rail to the plan voters will approve.

“We haven’t had a chance to fully vet it and I am not comfortable going to the community with something that is not fully vetted,” Patman said, noting some people have raised concerns.

I hope it’s not too late. This idea makes a lot of sense. Honestly, the biggest problem may be that just ending the line at Heights Boulevard will leave people clamoring to extend it further, and that may be too much to do right now. I’m okay with putting this off for a little while if what we can get in the end is the maximal extension that can be done. Table this for now if we must, but by all means get back to it ASAP.

Prop B layoffs rescinded

No Prop B, no need for layoffs. Funny how that works.

Houston City Council on Wednesday formally reversed the 220 firefighter layoffs and hundreds of demotions it approved earlier this year, making official Mayor Sylvester Turner’s pledge not to lay off or demote any firefighters in the aftermath of a judge’s ruling that Proposition B is unconstitutional.

Before a state district judge threw out Prop B, the voter-approved charter amendment granted firefighters the same pay as police of corresponding rank and seniority. Turner warned that Prop B would require layoffs to offset the cost of the raises, a point hotly disputed by the Houston Professional Fire Fighters Association. City council voted in April to send firefighters 60-day layoff notices, which the panel unanimously rescinded Wednesday.

The council also voted to reverse more than 400 demotions within the Houston Fire Department. The layoff notices had gone to the lowest-ranking firefighters, initially requiring the city to fill in those positions from the top down through demotions.

“This puts everything back the way it existed prior to that vote,” Turner said.

The city also had sent layoff notices to 47 municipal employees, but Turner already had rescinded those unilaterally because those layoffs did not require council approval.

Councilman Dwight Boykins asked Turner if the layoff reversal would impact Fire Chief Sam Peña’s proposed department restructuring, which would move HFD from a four-shift to three-shift model — a move the union opposes. Turner confirmed that Wednesday’s vote has no bearing on the proposed shift change.

Councilwoman Brenda Stardig also asked Turner if the city plans to recoup back pay granted to firefighters before Prop B was ruled unconstitutional. Some department employees received raises the week before the judge’s ruling.

Turner said his administration is “addressing how to deal with that issue,” but in the meantime he sees the raises as a “credit on future negotiations.” The mayor said last month that he did not intend to “claw back” funds from any firefighter.

Obviously, this isn’t the end. We’re about to have an election that will re-litigate this whole thing – though don’t expect anyone to give a plausible answer to how they would have handled this all differently – and that court ruling has been appealed to the 14th Court of Appeals. But in a real sense, this is over. Whatever happens next, it will occur in a context of Prop B not having happened. So maybe now, at least for a little while, we can talk about something else.

Here comes another referendum no one will understand

Be careful what petitions you sign, that’s my advice.

A political action committee is launching a petition drive Sunday aimed at limiting how much city contractors and vendors can contribute to municipal candidates, marking the start of a month-long effort to gather enough signatures to put the so-called anti-pay-to-play measure on Houston’s November ballot.

The drive is for a petition authored by a group of lawyers, including Houston mayoral candidate Bill King, that would amend a city ordinance to bar people who do business with the city from contributing more than $500 to candidates for municipal office.

Houston’s campaign finance laws allow individual donors to give candidates up to $5,000 every two years. Committees can contribute a maximum of $10,000 during the same span.

The amendment would further prohibit city board and commission members, as well as sexually-oriented business owners, from giving candidates any campaign money.

To put it on the ballot, the PAC — called “End Pay to Play” — must gather about 40,000 signatures from registered Houston voters within a 30-day window ending July 8. The city secretary would then verify the signatures, prompting city council to vote on holding an election to coincide with the Nov. 5 municipal contests.

We’ll see if this thing gets enough signatures in the allotted time. Collecting a sufficient amount of valid signatures takes resources, which is to say volunteers and/or paid canvassers. I don’t know how much grassroots energy exists for something like this, but I’ll be sure to look at the “End Pay to Play” PAC finance reports to see how they’re spending their money.

I have some questions about this. First of all, it sure seems to me like there may be some constitutional issues with the prohibitions this would impose. Last I checked, the First Amendment did not exclude strip club owners from the right to express their political beliefs. In a post-Citizens United world, where money is speech and corporations are people, it’s not clear to me that this would stand up to legal scrutiny. One possible outcome here is that not only is that provision struck down, but other parts of Houston’s campaign finance laws could be endangered. It’s not that long ago that the fundraising blackout rule got tossed by a federal judge. The potential here for unintended consequences is greater than zero.

I would also note that by going through the referendum process, this proposal will not get vetted by the legislative process. There will be no public hearings, no opportunities for Council members to ask questions or put forth amendments. I would argue that this is how you get a firefighter pay parity law passed that had no mechanism to pay for it (never mind the later ruling that it violated state law). There are times when the direct approach works well, and for sure there have been referenda that I have supported, such as Renew Houston, for which this criticism would also apply. Bill King, for one, has been critical of Renew Houston for this reason, among others. Here, though, King is actually running for Mayor, and it would be well within his capability if he wins to hand an ordinance for Council to vote on to do what’s in this referendum. Maybe he’s hedging his bets, maybe he just doesn’t want to get Council involved. Or, you know, maybe he sees a political advantage in taking this approach.

(Note that Bill King has taken it upon himself to crusade against campaign contributions from strip club owners. In case you were wondering why that particular legally questionable provision is in the petition, and why I say this is King working to his own advantage.)

(I know it’s a tedious bit of whataboutism, but Greg Abbott has made a career out of rewarding his campaign supporters. He went so far as to endorse the primary opponent of the Republican legislator who authored a bill that would have restricted this practice of Abbott’s. One can engage in government as one sees fit, but if there were evidence that, say, Bill King had encouraged people to email their State Rep in support of that bill, I might be a tad bit less cynical about his motives here.)

(The story notes that King himself used to be a player in this system that he now decries, as a partner at Linebarger Goggan. For this, I have no criticism of him. People are allowed to change their minds, and no one has to have a specific road to Damascus moment to do so. If he says he now regrets what he once did, I take him at his word. There’s plenty of room for me to snipe at his actions, as you can see.)

(No, I don’t know why I put all these last paragraphs in parentheses. Once I got started, it kind of built on itself. I’ll stop now.)

None of this is to say that we shouldn’t review our campaign finance and ethics ordinances. I just think we should do it in a more deliberative and rigorous process that ensures that the final product is compliant with existing federal law. I would also note that even outside that concern, we should be careful about how we regulate campaign contributions. If we make it harder for regular candidates to raise money for their campaigns, one effect of that will be that it confers an advantage to wealthy candidates who can self-finance their campaigns. I for one don’t think that’s much of an improvement.

Anyway. If you get accosted at the Kroger parking lot to sign a petition, please do be sure to know what it’s about before you affix your autograph. I personally would not sign this, but your mileage may vary.

Let the HD100 candidates come on out

With State Rep. Eric Johnson now also known as Dallas Mayor-Elect Eric Johnson, that means a special election for his legislative district is in the offing.

Dallas community advocate Lorraine Birabil has launched a campaign to replace outgoing state Rep. Eric Johnson, becoming the first of what’s expected to be a large field of contenders.

She told The Dallas Morning News that it’s critical for lawmakers to help develop criminal justice reform, access to affordable health care and quality public schools.

“This district has been home for me, and I know it’s important that we have opportunities for all,” Birabil said. “When we address these impediments, every Texan will be able to reach their full potential.”

Birabil won’t have the field to herself. The race to replace Johnson, who won Saturday’s runoff for Dallas mayor, is expected to be highly competitive.

At least 11 people have expressed interest or have been mentioned as possible candidates to fill his unexpired term in the Texas House.

That number could grow by the time Texas Gov. Greg Abbott sets a special election, presumably in November, to fill Johnson’s seat.

“People are interested in being involved,” said state Sen. Royce West, D-Dallas. “The fact is, a state representative seat doesn’t come open that often.”

Johnson has not resigned, and Abbott has not indicated when or if he’ll call a special election.

Looks like Inauguration Day for Johnson is Monday, June 17, so he’s going to have to resign before then. That leaves plenty of time to call a November special election, which I presume is what will happen. Assuming that is what does happen, whoever wins (in the runoff, of course) ought to be in good position to win the primary, which is what will really matter, as this special is only for the unexpired term. First, we need the resignation, and everything follows from there.

Scarface

If CM Dwight Boykins is running for Mayor, then someone has to run for District D.

Your mind isn’t playing tricks. A former member of the pioneering hip-hop group Geto Boys could wind up representing a large part of the city.

Brad Jordan, better known as his rap moniker “Scarface,” on Sunday announced his bid for Houston City Council District D. The seat is currently held by Councilman Dwight Boykins, who recently filed paperwork indicating he will run for mayor, according to earlier reports in the Houston Chronicle.

“It’s official,” the rapper said in an Instagram post. “I’m offering myself for service as the next Houston City Councilmember for District D. Join our movement! More details to come. www.bradfordistrictd.com.”

Fellow Houston rappers Paul Wall and Bun B have already showed their support for Jordan’s announcement online. “I’m here for this!” Bun B said in a comment on the post.

That website is just a placeholder right now, so check back later if you want to know more. I look forward to seeing his finance reports, I’ll tell you that much. I would expect that there will be multiple candidates in this race, even with a big-name person like Jordan jumping in. Welcome to the race, Scarface.

May runoff results

With 303 of 474 precincts reporting, State Rep. Eric Johnson was leading in the runoff for Dallas Mayor over Scott Griggs, 57% to 43%. At the time I started writing this I didn’t see any news coverage declaring the race to be over, but it sure looks to me like Johnson is going to win. So congratulations to (I presume) Mayor-elect Eric Johnson. You know what this means: There will be another special legislative election, which I would bet will be in November. Johnson’s HD100 is solid Dem so a flip is not in play, but expect there to be a big field.

On a side note here, Johnson knocked off longtime Rep. Terri Hodge (who would soon after be convicted of federal tax fraud charges) in 2010. He’s always struck me as someone who had his sights on bigger things. Having just achieved one of those bigger things, look for him to start getting mentioned in future conversations about statewide candidacy. I could definitely see him taking aim at Dan Patrick in 2022, or Ted Cruz in 2024. Just something to keep in mind.

In San Antonio, Mayor Ron Nirenberg held on.

Incumbent Ron Nirenberg retained his position as San Antonio’s Mayor after defeating Councilman Greg Brockhouse (D6) in the runoff election on Saturday.

Brockhouse officially conceded at 9:12 p.m.

With 96.98 percent of precincts counted, Nirenberg held 51.07 percent of the vote to Brockhouse’s 48.93 percent.

Nirenberg opened the night with a slight lead in early voting, which tightened as more precincts were counted. The margin was just 1.44 points with 78 percent of the precincts voting before a late surge gave Nirenberg the victory.

“I’ve never worked harder in my life to make sure that this city was well represented than over the last two years, but certainly over the last month where we had to remind folks that we can be a city for everyone,” Nirenberg said.

Finally, I’m sad to say that Nabila Mansoor failed to win her runoff in Sugar Land. She trailed by almost 600 votes early and closed the gap a bit on Election Day, but it wasn’t nearly enough.

Looks like Boykins is in for Mayor

This had been rumored for some time.

Houston City Councilman Dwight Boykins has filed paperwork indicating he will run for mayor, setting up a clash with incumbent Sylvester Turner and at least two other major candidates.

Boykins filed a report Tuesday afternoon with the city secretary designating a campaign treasurer, a necessary step to raise funds.

He listed former Houston mayor Lee P. Brown as his campaign treasurer.

Boykins, who represents District D, has signaled for months that he was considering a mayoral bid; he had said he would decide by June whether to run for mayor or seek re-election to his council seat.

On Saturday, a website surfaced at the domain name dwightboykinsformayor.com that included a page allowing visitors to register for an announcement event. The site later was taken down.

Though once a political ally of Turner, Boykins has become increasingly combative with the mayor amid the city’s ongoing labor dispute with the Houston Professional Fire Fighters Association.

Miya Shay has a photo of the paperwork on Twitter. I have three things to add at this time.

1. Nothing is final until the filing deadline passes. At this point in time in 2003, Michael Berry was a candidate for Mayor. He subsequently went back to running for Council. It seems quite likely Boykins will run at this point, but there’s still plenty of time for him to change his mind.

2. I’m kind of hard pressed to come up with an idea for what the Boykins for Mayor campaign will be about, other than “I promise to be nicer to the firefighters”. Which is fine, people can certainly think they deserve better than what they’ve gotten, but Prop B is now dead (pending appeal), and Boykins’ proposal to pay for it, which would have cost most homeowners something like $200 to $300 per year, maybe wouldn’t be all that popular. Some people like to talk about how Prop B passed with almost sixty percent of the vote. I wonder how it would have done if it had come with that price tag prominently displayed on it.

3. I know there are Democrats out there who are disappointed in Mayor Turner and who think he isn’t progressive enough. I would just like to remind them – and everyone else – that back in May of 2014 when City Council voted on HERO, Dwight Boykins voted “No”. He still refused to support HERO a year later when Council had to put the HERO repeal proposal on the ballot. I for one cannot and will not vote for anyone who didn’t support HERO. You do you, but that’s a deal breaker for me.

Moving ahead with voting centers

The first time was a success, so we’re going to keep using them.

Harris County Commissioners Court on Tuesday voted unanimously to apply for state approval to expand the use of countywide polling places to general elections.

County Clerk Diane Trautman said a trial run of the system during the low-turnout school board elections in May was successful. Trautman’s goal since taking office in January has been to implement countywide polling, where voters can cast ballots at any location rather than in assigned precincts, in high-turnout general elections which can draw more than 1 million voters.

Previously, Harris County featured countywide voting only at a small number of early voting sites, and never on Election Day.

“I am very pleased with the results of the May election,” Trautman said Tuesday. “As I hoped, in using a small election, we would find areas where to improve, and we did.”

Precinct 4 Commissioner Jack Cagle, who in the past has raised concerns about elderly voters losing their longtime polling places to consolidation, asked Trautman to promise to keep all polling places open. Trautman replied she would not close any sites.

County Judge Lina Hidalgo said the addition of countywide polling centers should make voting more convenient, since residents can use sites close to work or school, and boost turnout.

“It’s bringing that increased access to the vote to so many more people,” Hidalgo said.

A Rice University survey of 256 voters in the May election by Elizabeth Vann and Bob Stein found that most residents visited polling sites within one mile of home.

“Did voters seem satisfied? Overwhelmingly,” Stein said. “About 90 percent claimed they were satisfied finding their location.”

Stein, a professor of political science, cautioned that higher-turnout elections will bring additional challenges, such as long lines and parking problems. He said he plans to study the 2019 Houston municipal elections in November, which will have higher turnout than the May school board balloting, but still low compared to a November midterm or presidential election.

I’m very glad to hear that the people who voted liked the experience. I’m a confirmed early voter, so nothing will change for me, but lots of people vote on Election Day, and this should make it better for them. I have very modest expectations about how it will affect turnout, but I do think it will help keep lines from getting too long. There are improvements I’d like to see made in how the returns are reported, which I hope can be in place for this November. Otherwise, I look forward to getting this implemented.

The timeline for driverless cars

We know they’re coming, but how long it takes them to get here really matters.

For Elon Musk, the driverless car is always right around the corner. At an investor day event last month focused on Tesla’s autonomous driving technology, the CEO predicted that his company would have a million cars on the road next year with self-driving hardware “at a reliability level that we would consider that no one needs to pay attention.” That means Level 5 autonomy, per the Society of Automotive Engineers, or a vehicle that can travel on any road at any time without human intervention. It’s a level of technological advancement I once compared to the Batmobile.

Musk has made these kinds of claims before. In 2015 he predicted that Teslas would have “complete autonomy” by 2017 and a regulatory green light a year later. In 2016 he said that a Tesla would be able to drive itself from Los Angeles to New York by 2017, a feat that still hasn’t happened. In 2017 he said people would be able to safely sleep in their fully autonomous Teslas in about two years. The future is now, but napping in the driver’s seat of a moving vehicle remains extremely dangerous.

In the past, Musk’s bold predictions have been met with A-for-effort enthusiasm and a smattering of polite skepticism. But the response this time has been different. People have less patience for PR campaigns masquerading as engineering timelines. “That’s bullshit,” says Sam Abuelsamid, a research analyst for Navigant, a consulting firm that ranks companies on the viability of their autonomous vehicle plans. “At best, they may be able to create a system that functions under certain limited scenarios. It will not be fully autonomous in 2020 or anytime in the next several years.”

What’s changed? Self-driving cars—and their associated building blocks such as machine learning, computer vision, and LIDAR—continue to improve, but executives other than Musk have been admitting that reports of their impending deployment were greatly exaggerated. Ford CEO Jim Hackett said last month that the industry had “overestimated the arrival of autonomous vehicles.” Chris Urmson, the former leader of Google’s self-driving car project, once hoped that his son wouldn’t need a driver’s license because driverless cars would be so plentiful by 2020. Now the CEO of the self-driving startup Aurora, Urmson says that driverless cars will be slowly integrated onto our roads “over the next 30 to 50 years.” That’s nearly as long as it took computers to evolve from IBM’s first mainframe to Apple’s first iPhone.

I touched on this recently in the context of ridesharing companies and their existential future, which is based in part on self-driving technology. I’ll say again, the prospect of driverless cars has an effect on current policy debates. If you believe they will be in common usage in the next five to ten years, then it’s reasonable to expect that they will begin having a significant effect on driving habits and traffic patterns in the short term. In particular, this argues for a change in approach to how we invest in infrastructure and mass transit. As that link suggests, why spend on rail projects when you can build souped up HOV lanes that will accommodate autonomous buses that travel at 80 to 100 MPH?

But if we’re on a thirty to fifty year horizon, then basically nothing has changed and we should proceed as if driverless cars are no more a part of the landscape than the flying cars we were once promised. Fifty years is forever in infrastructure terms. Hell, thirty years is a very long time. All but six MLB stadia are thirty years old or less, and many of the new stadia replaced other facilities that were between 30 and 40 years old. I’ve lived in Houston for 31 years, and every single highway in this town has been substantially rebuilt during that time frame, some more than once. The same argument about whether or not to invest in light rail should apply to the planned mammoth rebuild of I-45, which last I checked isn’t geared towards high-speed robot buses. I say nothing is worth delaying or deferring for a possible future with a timeline that may be measured in decades. I guarantee this issue will come up when the Metro referendum is officially put on the ballot. I’m happy to discuss how we should integrate autonomous vehicles into our traffic and transit planning, but let’s keep this in mind.

Still working on the light rail options for MetroNEXT

The most interesting part of this discussion of where a proposed extension of the Green and/or Purple lines to Hobby Airport may go is unfortunately not on the drawing board at this time.

Speaking before the METRO board, District I City Council Member Robert Gallegos said he’s heard a lot of objections to one proposal that would take the train down 75th Street. He said he worries a rail line would interfere with a big park improvement project.

“We have a beautiful green space, Mason Park,” said Gallegos. “We have a master plan. I’ve met with community three times. They’ve had input on what they’d like to see at that park.”

Other proposals for the Hobby line would put the train on major thoroughfares like Broadway Street and Telephone Road. Board Chairman Carrin Patman said the challenge is finding the most efficient route along existing streets.

“The time to get to airports matters for people using it for that purpose,” said Patman. “The more zigs and zags you have the more time is added.”

At their May meeting, board members also viewed a proposal for light rail on Washington Avenue between downtown and Heights Boulevard, but that plan was presented only for discussion.

The long-range plan already includes a 0.2-mile extension of the Green and Purple Lines from their western end in the Theater District of downtown to the Houston Municipal Courthouse. The new proposal, suggested by officials with the Houston Downtown Management District, would continue that extension further, likely by taking the line along Houston Avenue and then west on Washington Avenue. Additional stops would be at Sawyer and Studemont.

“I would be really curious what the ridership models will show,” said Metro board member Sanjay Ramabhadran.

Officials stressed the proposal is being evaluated and is not part of the plan, yet.

“We’re looking at it,” Patman said.

With few specifics outlined, many residents of the nearby Sixth Ward, bordered by Buffalo Bayou and Washington Avenue, and the Heights cheered the possibility.

See here for the background. Dug Begley of the Chron tweeted what a Washington extension might look like. I like the idea, but I agree with the commenters who ask why stop there. I proposed what was then a stand-alone and now would be an extension of the existing Green and Purple lines all the way to the Galleria way back in 2009. None of this is remotely feasible now, and there would be engineering challenges even if it were politically and financially doable, but it would be high-quality transit through a part of town that could easily support it, and would offer multiple connections to high frequency bus lines as well as to the Uptown BRT line, which in turn could get you to the high speed rail terminal at 290 and 610. The idea is free if you ever decide to use it, Metro.

The state of the city 2019

There are still things to do that don’t have to do with the endless fight over Prop B.

Mayor Sylvester Turner used his fourth annual State of the City address Monday to announce a plan aimed at drawing private investment to city parks in underserved areas, while casting the state of the city as “strong, resilient and sustainable,” a depiction his mayoral opponents swiftly rejected.

Turner, who is up for re-election in November, also renewed his call for a multimodal transit system with rail and bus rapid transit, urging residents to give Metro borrowing authority for its long-term plan in November. The agency is expected to put a multi-billion-dollar bond request on the ballot.

“This is not the city of the 1990s,” Turner said. “This city has changed. The region is changing. People are demanding multimodal options, and we have to give it to them.”

Speaking to a packed crowd of elected officials, city staff and the business community, the mayor pitched Houston as a prime location for technology startups, touting steps the city has taken to expand its tech presence. He acknowledged that “Silicon Bayou” has played catch-up to other cities that were faster to attract talent.

“It makes no sense why the (tech) ecosystem in Houston should not be No. 1 in the world,” Turner said, pointing to the city’s large medical center, multiple universities and reputation as the world’s energy capital.

Several minutes into his address, delivered at the Marriott Marquis hotel downtown, Turner announced a “50-for-50” plan aimed at revitalizing city parks “primarily in communities that have been underserved.” Under the plan, Turner said, 50 companies would each “partner” with a city park, volunteering to “take ownership” of the park and maintain it for about five years.

[H-E-B President Scott] McClelland, who chairs the Greater Houston Partnership, committed onstage to participate in the program.

I’m more interested in seeing Mayor Turner give full-throated support to the Metro referendum, which we are very much going to need. We can go from a city and a region that has okay transit to a city and a region that has good transit, if we want to. The only person running for Mayor that I trust with that is Mayor Turner.

We’re going to vote on making an income tax double secret illegal

It’s definitely time for sine die.

Texas voters will decide in November if they want to bar the imposition of an income tax, following approval of the constitutional amendment by the state Senate on Monday.

The Texas House had approved House Joint Resolution 38, which prohibits the imposition of an individual income tax, earlier this month.

The seemingly anodyne proposal ran into pushback Monday from some Senate Democrats who suggested the bill could cut business taxes, a major source of state money.

There appears to be no threat of an income tax currently — no such bill appears to have been filed, let alone have reached the floor of either chamber, where it would be political kryptonite. And a 1993 constitutional amendment already holds that Texas can adopt a state income tax only if voters approve and that the money would go for the “support of education.”

But Senate Democrats on Monday sparred with Republicans over a seemingly arcane bit of language that could carry big budget implications.

The resolution says that the Legislature may not impose a net income tax on “individuals.”

Democrats, pointing to an analysis by the state’s nonpartisan Legislative Budget Board, said that could be interpreted by courts to apply to businesses, especially because the measure’s language uses that term rather than “natural persons,” which is often used in statutes.

The business levy, long a target of Republicans eager to shave taxes, brings in about $8 billion per biennium, helping to fund public schools.

“The term ‘individuals’ is not defined and could be interpreted to include entities that are currently subject to the state’s franchise tax,” the Legislative Budget Board analysis reads. “To the extent the joint resolution might exempt some entities from the franchise tax, there could be a loss to state revenue.”

Earlier during the debate, [author Sen. Pat] Fallon said the constitutional amendment would firm up the state’s opposition to income tax.

“I’m always in fear of an income tax,” he said. “Every day I wake up, the thought of Texas having an income tax makes me shudder. Physically shudder, not metaphorically.”

Seriously? Mere words cannot adequately express my reaction to Sen. Fallon’s delicate sensibilities, so mark me down as being somewhere between here and here. I do hope you sleep better tonight, Senator, and if not I recommend warm milk and a bedtime story, preferably one with a happy ending. As for my reaction, here it is:

“Why would pesky LBB fiscal facts be any help when discussing a major source of state revenue for schools?” Eva DeLuna Castro, a budget analyst with the left-leaning Center for Public Policy Priorities, wrote on Twitter. “I mean, it’s not as if major business conglomerates have highly paid tax lawyers waiting in the wings to explain why they are ‘individuals’ too.”
