2018 primary runoff results: Congress and Legislature

All results are here. I began drafting this around 9:30 when there were still a bunch of precincts out, but with the exception of the tossup in CD25, all of the Congressional races were pretty clear by then:

At the time I started writing this, Julie Oliver led in CD25 by 70 votes out of almost 18,000 cast and about three quarters of precincts reporting. Later on, she had pulled out to a five point lead, so add her to the winners’ list as well.

On the legislative side, Rita Lucido was leading in SD17, Sheryl Cole had a modest lead in HD46 with most precincts reporting, Carl Sherman had a much bigger lead in HD109, and longtime Rep. Rene Oliveira had been shown the door.

As for the Republicans, Dan Crenshaw won big in CD02, Lance Gooden won in CD05, so no more Republican women in Congress, Chip Roy and Michael Cloud led in CDs 21 and 27, respectively. The wingnuts in HDs 08 and 121 lost, and incumbent Rep. Scott Cosper lost.

Congratulations to all the winners. I’ll have some more coherent thoughts on all these races in the next day or so.

Burch was above fifty percent for most of the evening on March 6, but eventually fell less than 250 votes short of the mark. She was endorsed by the DMN for the primary. This North Texas Gazette story has a bit about these candidates, as well as those in the CD06 and CD32 runoffs.

It doesn’t get much closer than this – fifteen votes separated Woolridge and Sanchez in March. Woolridge is a rare candidate in these races that has run for Congress before – she was the Dem nominee in 2016. She has the endorsements of the DMN and the Star-Telegram, though I can’t find the link for the latter. Sanchez has been the stronger fundraiser. She doesn’t appear to have done any fundraising. Siegel has the Chron endorsement and picked up the HGLBT Political Caucus endorsement for the runoff.

The CD21 primary was the original “establishment/centrist versus outsider/lefty” primary, though the role of the latter was initially played by Derrick Crowe. Mary Wilson kind of came out of nowhere – if you want to posit that she benefited by being the only woman in the four-candidate race, I won’t stop you – and has been receiving some catch-up media coverage since. The Statesman did profiles of both candidates – Wilson here, Kopser here – and Texas Public Radio has more.

Like CD21, this runoff has an “establishment/outsider lefty” narrative, but it wasn’t supposed to be that way. It started out as a battle between establishment factions, but that crashed to earth in March when the Castro-backed Jay Hulings came in fourth. I said my piece about this one a couple of days ago, so let me just add that Gina Ortiz Jones has the potential to be a star if she can win and win again in 2020. She’s already probably the most-covered candidate (non-Beto division) in the state, and her combination of youth, background, and willingness to speak bluntly is a good recipe for continued attention from the national press. If she wins and can get re-elected, I don’t think it would be crazy to imagine her getting touted as a statewide candidate in the near future, perhaps in 2022 for Governor or 2024 for Senate if Beto can’t knock off Cruz.

I haven’t paid a whole lot of attention to this race, as CD25 is a notch or two down on the competitiveness list. It’s not out of the question that this could be competitive in November, but if it is Democrats are having a very, very good day. The AusChron and the Statesman have a couple of good recent profiles of this race the the two remaining candidates, both of whom look perfectly acceptable. According to Ed Sills’ email newsletter, Julie Oliver recently joined Laura Moser and Mike Siegel in having their campaigns get unionized, a trend that I approve of. Whoever wins, I hope he or she puts up a good fight against empty-suit-with-Rick-Perry-class-hair Roger Williams.

First round: Barrera 41.23%, Holguin 23.30%

I had some hope in this one early on, but that pretty much dissipated when Ducky Boy Farenthold was able to slink off into the sunset. With boring generic Republicans in the running for the nomination, this is a boring generic race in which the Rs are heavily favored. I don’t have much expectation for the special election in August, as the multiple Democratic candidates on the ballot will likely split the vote enough to produce an all-R runoff. There are plenty of other races out there to get invested in.

First round: Hegar 44.93%, Mann 33.51%

Hegar is the high-profile candidate in this race, and she has been the much stronger fundraiser. She’s got a great story as a Purple Heart recipient and advocate for women who’s published a book on her experiences and gets invited to participate in things like the Texas Monthly Women’s Voices Project, but Mann was in the race earlier and picked a pretty good year to run for Congress as a doctor. Like Gina Ortiz Jones, I think Hegar has star potential, but her road to Congress is a lot rougher. The AusChron and Killeen Daily Herald have brief overviews of this race.

First round: Allred 38.43%, Salerno 18.35%

Another runoff where the script deviated from what we might have originally expected. Ed Meier, an Obama administration alum and the top fundraiser going into March, fell short as Allred ran well ahead of everyone else in the field. I have to think he has the edge just by the numbers, but Salerno has been no slouch at fundraising, and female candidates as a group did very well in March, so don’t go counting chickens yet. The Dallas Observer did some good Q&As with these candidates before the primary – here’s Allred, here’s Salerno – and there are more recent Q&As from the UTD Mercury with Allred and the Preston Hollow People with Salerno. The DMN, which endorsed Allred, has a runoff overview here. And my favorite news bite on this race: A Marijuana Super PAC Is Targeting Pete Sessions. Smoke ’em if you got ’em, y’all.

I’ll round up the legislative runoffs tomorrow.

A primary runoff threefer

It’s getting chippy in CD02.

What started off as a relatively cordial campaign between two Republicans who want to represent parts of Houston in Congress has gotten downright testy as early voting looms.

Eight weeks ago, Dan Crenshaw and Kevin Roberts were publicly declaring their respect for one another and making plans to visit a gun range together. Now the men are accusing each other of twisting words to score political points ahead of early voting, which begins May 14. Election Day is May 22, two weeks from Tuesday.

Over the last several days Crenshaw and his supporters have accused Roberts of disrespecting the his experience and that of all U.S. military veterans — something Roberts called “an absolute lie.”

That came just days after Roberts said Crenshaw demeaned Christianity in a Facebook post years ago, a claim Crenshaw called false and a “new low even for a politician like Kevin.”

The heightened intensity between the two shows how in a tight Republican primary in which candidates hold many of the same core philosophies, personalities inevitably become a key part of the race.

You can read the details as you see fit. It’s petty and personal, which as noted in that last paragraph is usually how things go. Lord knows, there are plenty of people on my side who are MORE THAN READY for the primary season to be over about now. One thing the story doesn’t note is the TV ads that are once again sullying my live-sports-watching experience, as some shadowy deep-pockets group accused Crenshaw of being insufficiently toadying to Donald Trump. They’re not as bad as the Kathaleen Wall ads, because nothing will ever be as bad as the Kathaleen Wall ads, but they’re bad.

Meanwhile, in CD21 there are two sets of runoffs keeping everyone busy.

With just a week remaining before the start of early runoff voting, the two Republicans and two Democrats vying to succeed longtime U.S. Rep. Lamar Smith (R-San Antonio) pressed the flesh at a candidate forum Monday in San Marcos.

More than 50 people attended the “meet and greet” event organized by the League of Women Voters of Hays County at the San Marcos Activity Center, taking the opportunity to hear from the congressional candidates in advance of the May 22 runoff. Each candidate had five minutes to give an introductory speech to the audience and provide his or her qualifications for public office.

The GOP ballot has Boerne business owner Matt McCall squaring off with Chip Roy, a former chief of staff for U.S. Sen. Ted Cruz (R-Texas) who lives in Dripping Springs. The Democratic runoff is a contest between two Austinites – businessman and U.S. Army veteran Joseph Kopser and Mary Street Wilson, an educator-turned-minister.

McCall and Roy have cast themselves as conservative Republicans who advocate limited government, a free market economy, a strong military, better border security, and a pro-life approach to reproductive rights.

In his remarks to the audience, Roy made an appeal to Democratic, GOP, and independent voters in the crowd.

“Fundamentally, I believe we have an opportunity right now to reunite this country around our shared values,” said Roy, who also has worked Texas Attorney General Ken Paxton, and former Gov. Rick Perry. “I think we’ve got an opportunity to get back to the things we all care about on a non-partisan basis.”

Roy said that all people should care about the ever-growing national debt, rising health insurance premiums, a flawed immigration system, and ill-equipped military personnel.

“We have disagreements on how we get to the solutions, and that’s fine,” he said.

Roy, who most recently worked for the Texas Public Policy Foundation, an Austin-based conservative think tank, said he agrees with the federal government handling fewer national issues, and letting states address most other issues, such as health care.

“Let California be California and let Texas be Texas,” he said. “Let us be able to figure out these things at the local and state level.”

Roy almost sounds reasonable there, doesn’t he? I don’t buy it, but compared to what he could be saying, it’s not terrible.

And finally, look at the underdog in CD23.

On the last Wednesday in April, things are not going as planned for Rick Treviño. He has just driven two-and-a-half hours from San Antonio, where he lives, for a local Democratic event, only to find that it’s been rescheduled for later in the week. So, he decamps to a McDonald’s inside a Walmart here in Eagle Pass, a border town that’s in the far southeastern corner of Congressional District 23, the sprawling West Texas district that Treviño is gunning for as a Democrat. Frustrated and with five hours to kill until a meet-and-greet event in the evening, Treviño called an audible. He was going to knock on some doors.

Using the McDonald’s Wi-Fi, he logged onto his account with the Texas Democratic Party’s voter database to, as he puts it, “cut turf” on the fly. With the help of a campaign volunteer over the phone, he quickly pulled together a list of a few dozen homes in Eagle Pass.

“This is a grassroots campaign, man,” he tells me. And this, Treviño says, is how — with next to no money — he squeaked into the Democratic runoff, beating three other candidates, including Jay Hulings, the Castro brothers’ favorite who raised more than $600,000. “I win when I’m at the doors. I win when I’m talking to people.”

It’s also how he plans to win his runoff against Gina Ortiz Jones, a former Air Force intelligence officer who won the crowded five-person primary with a commanding 40 percent of the vote. Treviño trailed Ortiz Jones by more than 10,000 votes.

But Treviño doesn’t see Ortiz Jones as his only opponent in the May 22 runoff. He says he’s running against the entire Democratic Party establishment and its hackneyed approach to politics. After the March 6 primary, the Democratic Congressional Campaign Committee (DCCC) placed Ortiz Jones on its Red to Blue list of top-priority candidates, citing her long list of both local and national endorsements.

His bid has support from the phalanx of new groups like Our Revolution, the Sanders’ campaign offshoot, Justice Democrats and Brand New Congress that are promoting anti-establishment candidates in congressional races around the country.

“He’s the new populist candidate in the old populist state of Texas,” says Jim Hightower, who heads Our Revolution Texas. “Candidates like Rick have a genuine message not developed in a think tank or by political consultants but out of his heart and his gut. And he conveys that with great conviction to voters and potential new voters.”

These groups have helped bring in small donors and door-knocking volunteers. But for the most part, Treviño’s campaign is a one-man show.

Emphasis mine. I bolded that section because a peek at Treviño’s campaign finance report shows what this means in practice. Click on the Browse Receipts button, and you will see that Treviño has taken in a total of ten donations for the runoff. One is from Justice Democrats and one (a max $2,700 contribution) is from someone in Colorado, so in all eight individuals have donated to him since he placed second in the primary. A tsunami that ain’t.

As for Ortiz Jones, who gets her own fawning profile from the Current, had 42 contributions from ActBlue among the first 100 in her report. A lot of PAC money in there too, to be sure, but many many times as many individual donations. I’ve got nothing against Rick Treviño, who seems like a good guy who’s working hard in this race. I just wonder about the definition of “grassroots” sometimes, and who gets to define what it means.

For comparison purposes, here’s what the 2008 cycle fundraising numbers looked like for Texas Democrats. Remember, those numbers are all the way through November, and nearly everyone in the top part of the list was an incumbent. Daily Kos has some of the same numbers I have – they picked a slightly different set of races to focus on – as well as the comparable totals for Republicans. Note that in several races, at least one Democratic candidate has outraised the Republican competition, either overall or in Q1 2018. This is yet another way of saying we’ve never seen anything like this cycle before.

As of this writing, Tawana Cadien had not filed her Q1 report. Christine Mann’s report showed a negative cash balance; I have chosen to represent that as a loan owed by the campaign. Everything else is up to date.

I continue to be blown away by the amount of money raised by these candidates. Already there are five who have exceeded one million dollars raised – Alex Triantaphyllis, who did not make the runoff in CD07, had topped the $1 million mark as of March – with Colin Allred sure to follow, and Todd Litton and MJ Hegar on track if Hegar wins her runoff. In some ways, I’m most impressed by the almost $300K raised by Dayna Steele, who has the advantage of being a well-known radio DJ and the disadvantage of running in a 70%+ Trump district. When was the last time you saw a non-self-funder do that? I’ll be very interested to see how the eventual nominees in the districts that are lower on the national priority lists do going forward. How can you ignore a CD06 or a CD22 if the candidates there keep raking it in? It will also be interesting to see what happens in CD21 going forward if the runoff winner is not big raiser Joseph Kopser but Mary Wilson instead. Does she inherit the effort that had been earmarked for CD21, or do those resources get deployed elsewhere, not necessarily in Texas?

Republican candidates have been raising a lot of money as well, and national groups are pouring in more, with CDs 07 and 23 their targets so far. We may see more districts added to their must-protect list, or they may make a decision to cut back in some places to try to save others. It’s worth keeping an eye on.

Who knew that was even legal?

Several of the most truly competitive House races in the country are in Texas, which could wind up providing Democrats three or more of the 24 flipped seats that they need for control of the chamber. The state tells the tale of the November midterms as well as anywhere else.

The appeal of youth, of first-timers, of women, of veterans and of candidates of color will be tested here. And a bevy of compelling characters have emerged from the primaries on March 6 and are poised to prevail in runoffs on May 22.

There’s Gina Ortiz Jones, for example. Jones, 37, is almost certain to be the Democrat challenging Representative Will Hurd in the 23rd District, which sprawls from San Antonio to the outskirts of El Paso. Despite its large numbers of rural voters, Hillary Clinton beat Donald Trump in the 23rd by more than three points. (Clinton lost the state by nine.)

Jones was an Air Force intelligence officer in Iraq. Like Conor Lamb in Pennsylvania, she drew the support of the Serve America PAC, which promotes veterans as candidates on the theory that they can help Democrats forge a cultural connection with working-class voters in swing districts.

She’s Filipina-American. She’s also openly lesbian, and while Texas political analysts told me that they weren’t sure whether that would affect her bid, Jones has figured out precisely how to handle it: with brief acknowledgment and no special focus.

Colin Allred

Democrats also have an excellent shot at victory in the 32nd District, a collection of Dallas neighborhoods and suburbs. Its Republican incumbent, Pete Sessions, has been in Congress for two decades, but the district has become more diverse and less white over those years, and his likely opponent, a black civil rights lawyer named Colin Allred, should benefit from that.

Allred is 34. Like Jones, he’s making his first run for office. Also like her, he has an unconventional professional biography. Before getting his law degree at the University of California, Berkeley, he played professional football for the Tennessee Titans, and before that he was a football star at Baylor University in Waco and at a high school in his Dallas district. Many of its voters remember watching him play.

And more of them voted for Clinton than for Trump in the presidential election, a sign of the district’s evolution and an outcome for which Democrats were so unprepared that not a single Democrat challenged Sessions in 2016. This time around, seven Democrats entered the race. Allred got 38.5 percent of the votes in the primary, more than twice that of the second-place finisher.

Democrats are even eyeing a few districts that Trump won, like the 21st and 31st. The 21st attracted the party’s attention largely because its Republican incumbent, Lamar Smith, isn’t seeking re-election. He decided to retire after more than three decades in the House.

And the 31st? Well, it’s hard not to indulge in some optimism when your party’s leading candidate is a female war hero whose story is possibly becoming a movie, “Shoot Like a Girl,” starring Angelina Jolie. That candidate, M. J. Hegar, 42, did several tours of duty in Afghanistan as a search-and-rescue pilot and won a Purple Heart after she was wounded while saving fellow passengers when the Taliban shot down her helicopter.

Richard Murray, a professor of political science at the University of Houston, told me to keep an eye as well on the 22nd District, a largely suburban swath of the Houston area that he described as a microcosm of demographic changes that are making the state ever more hospitable Democratic turf.

“The suburban counties that led Republicans to dominance here 25 years ago are getting significantly less Republican fast,” he said, adding that Fort Bend County, in the 22nd, is roughly 20 percent Asian-American now. The first-place finisher in the district’s Democratic primary, Sri Preston Kulkarni, is Indian-American. Murray said that if Kulkarni wins his runoff, that could be a significant boost to Democrats’ chances to nab this House seat.

Couple things here. All these matchups are contingent on the outcome of the runoffs. While Ortiz Jones and Allred are solid favorites in May based on their performances in March, the others are less clear. Kulkarni led runnerup Letitia Plummer 31.9 to 24.3, which is far from insurmountable. Hegar drew 44.9%, better than either Ortiz Jones or Allred, but second place finisher Christine Eady Mann had 33.5%, so her lead is much smaller. And then there’s the 21st, where the more establishment (and big money) candidate Joseph Kopser trailed the less-heralded Mary Wilson by two points. It will be interesting to see how this one is perceived if Wilson prevails in the runoff.

There are other districts that author Frank Bruni could have included as well, mostly CDs 02 and 06, both of which are open seats. Plus, you know, CD07. It’s important to remember that with the exception of CD23, all these districts were drawn to withstand a strong Democratic year, though that will be tested in November. Candidate quality does make a difference in tough races, and the basic thesis that the Dems here have collected a quality slate is accurate. From here on out it’s all about execution.

The DCCC elsewhere in Texas

Colin Allred

The U.S. House Democratic campaign arm may well be at war with another Texas Democrat.

Lillian Salerno, a Democratic House candidate in the Dallas-based 32nd Congressional District, pushed out a fiery news release on Thursday afternoon when the Democratic Congressional Campaign Committee telegraphed its preference for her primary rival, former NFL football player Colin Allred.

“Folks here are sick and tired of a bunch of Washington insiders trying to make their decisions for them,” she said. “But I’m not scared — I’ve stood up to power and fought for what’s right my entire life.”

“Texas hasn’t elected a new woman to Congress in twenty-two years, and we’re not taking it anymore,” she added. “The DCCC would do well to remember: Don’t mess with Texas women.”

At issue was a new list the committee released called “Red to Blue” candidates. The designation serves to signal to donors and DCCC allies which candidates the committee believes should be top recipients for contributions.

Red to Blue is not technically an endorsement from the DCCC. But DCCC Chairman Ben Ray Luján heaped praise on Allred in a committee news release on Thursday.

“Raised by a single mom who taught for 30 years in Dallas’s public schools, Colin Allred has never lost touch with the community that shaped him,” said Luján.

“Now, after representing his community on the football field and standing up for working people’s dignity in the Obama administration, Colin is running to put everyday Texans before special interests. Colin’s experience and new ideas will give North Texas a fresh start as they look to replace a politician who’s spent 20-years too many in Washington.”

In past cycles, the DCCC has named districts to its Red to Blue program, rather than specific candidates, to avoid these kinds of flare-ups.

The committee also named retired Air Force Intelligence Officer Gina Ortiz Jones to the program, who is running to take on U.S. Rep. Will Hurd, R-Helotes. Like Allred, she is in a runoff for her party’s nomination. Both Allred and Jones significantly outpaced their closest rivals in the first round of the primary contest.

She carried 41 percent of the vote in her district, compared to rival Rick Treviño’s 17 percent. Allred won 39 percent of the vote to Salerno’s 18 percent.

Here’s the full list of supported candidates so far. CD07 is not there yet, which seems like a bit of delayed discretion. What makes this different than the DCCC’s previous incursion is pretty simple: They have taken a position for a candidate, instead of against one. Both Allred and Ortiz Jones can reasonably be called the frontrunners, too, though anything can happen in a runoff. One can certainly argue that the DCCC should have waited these races out before getting involved, but if these are the candidates they want to support, then the case for working with them to ensure they get nominated is pretty clear. I sympathize with Trevino and Salerno, who has the support of Emily’s List, but that’s politics. I say don’t get mad, prove ’em wrong and make ’em support you in November instead.

On a side note, while Salerno is correct about the paucity of women elected to Congress from Texas, we’re going to get at least two more of them this year. In addition, if you look at that red-to-blue list, eighteen of the 33 candidates being supported by the DCCC at this time are women. And assuming the DCCC eventually supports the nominee in CD07 – yeah, that might mean making nice with Laura Moser; politics is full of such opportunities – then two of the three Texans they support will be women, too. I get why she’s unhappy and I don’t blame her, but I get what the DCCC is doing in these races, too.

(Please note that all results were coming in very slowly. I expect there will still be some precincts not yet reported by the time this publishes. So, I’m going to be less specific than usual, and may have to make a correction or two by Thursday.)

Barring anything strange, Texas will have its first two Latina members of Congress, as Sylvia Garcia (CD29) and Veronica Escobar (CD16) were both over 60%. I for one approve of both of these results. Now we can have that important debate about whether one of them is officially the “first” Latina or if they both get to share that designation; I lean towards the latter, as you know, and it appears that the Trib is with me as well. Maybe this will be a short debate. In any event, my congratulations to both women.

Todd Litton was over 50% in CD02 with about a third of the precincts in. Lizzie Fletcher and Laura Moser were headed towards the runoff in CD07 with just under half of the precincts reporting; Jason Westin was within about 850 votes of Moser, but he was losing ground. I will note that Fletcher, who led Moser by about seven points overall, led her in absentee ballots by 36-18, in early in person votes by 30-23 (nearly identical to the overall tally), and on E-Day 28-27. Maybe that’s the DCCC effect, maybe Fletcher has earlier-by-nature voters, and maybe it’s just one of those random and meaningless things.

Other Dem Congressional results of interest:

– Gina Ortiz Jones was at 40% in CD23, so she will face someone in the runoff. Judy Canales and Rick Trevino was neck and neck for second, with Jay Hulings trailing them both by about two points.

– Colin Allred was also around 40%, in the CD32 race. Lillian Salerno, Brett Shipp, and Ed Meier were competing for runnerup, in that order.

– Joseph Kopser and Mary Wilson were right around 30% for CD21, with Derrick Crowe just under 23%.

– Jana Sanchez and Ruby Faye Woolridge were both around 37% in CD06.

– MJ Hegar and Christine Eady Mann were well ahead in CD31.

– Jan Powell (53% in CD24) avoided a runoff. Lorie Burch (49% plus in CD03) just missed avoiding one.

– Sri Kulkarni was at 32% in CD22, with Letitia Plummer and Steve Brown both around 22%. In CD10, Mike Siegel was up around 43%, while Tawana Cadien, Tami Walker, and Madeline Eden were in the running for the second slot.

– Dayna Steele was winning in CD36 handily. This is one of those results that makes me happy.

– On the Republican side, Lance Gooden and Bunni Pounds led in CD05, Ron Wright and Jake Ellzey led in CD06, Michael Cloud and Bech Bruun were the top two in CD27. I have only a vague idea who some of these people are. Ted Cruz minion Chip Roy led in the CD21 clusterbubble, with Matt McCall and William Negley both having a shot at second place. Finally, Kevin Roberts was leading in CD02, and while Kathaleen Wall had the early advantage for runnerup, Dan Crenshaw was making a late push, leading the field on E-Day. Dear sweet baby Jesus, please spare us from two more months of Kathaleen Wall’s soul-sucking TV ads. Thank you.

– I would be remiss if I did not note that Pounds has a decent shot at being the third woman elected to Congress from Texas this year; if she prevails in the CD05 runoff, she’ll be as in as Garcia and Escobar are. Wall’s path to that destination is a bit cloudier now, but unless Crenshaw catches her she still has a shot at it.

– Some of these results were changing as I was drafting this. Like I said, I’ll likely have some cleanup to do for tomorrow. Check those links at the top of the post.

Trib overview of CD23 primary

Definitely a key race.

Now, CD-23 is faced with its most crowded Democratic race in decades to determine who will duke it out in November in what is regularly ranked as one of the country’s most competitive districts. It spans San Antonio to El Paso and includes hundreds of miles of the U.S.-Mexico border, a massive, largely rural area with a predominantly Hispanic population.

Four Democrats are seriously vying for the seat in the March 6 primary: Judy Canales, a former Bill Clinton and Barack Obama appointee from Eagle Pass; Hulings, a former federal prosecutor from San Antonio; Gina Ortiz Jones, a former Air Force intelligence officer from San Antonio; and Rick Treviño, a former high school teacher from San Antonio who unsuccessfully ran for city council there before entering the TX-23 primary last year. A fifth Democrat, Angela “Angie” Villescaz, filed for the seat but does not appear to be running as active a campaign as the others.

With a week and a half until Election Day, much attention has centered on Hulings and Jones, who appear poised for a runoff if neither can garner over 50 percent of the vote on March 6. Propelled by EMILY’s List, the influential national group that helps elect Democratic women who support abortion rights, Jones has shown serious fundraising momentum, raking in $282,000 in the first 45 days of 2018 — more than three times Hulings’ total over the same period. She entered the homestretch of the race with a more than 2-to-1 cash-on-hand advantage over Hulings, $217,000 to $101,000.

The two are drawing their support from distinct corners of the Democratic universe. Hulings enjoys the support of Democratic congressional leaders such as House Minority Whip Steny Hoyer, as well as political figures well known within the district, including his law school classmates, the Castro brothers. Hulings, who is Mexican-American, also has the backing of the Congressional Hispanic Caucus and the moderate Blue Dog Democrats.

Jones, meanwhile, is being backed by veterans and LGBT groups, in addition to EMILY’s List. She has also been endorsed by two of the most prominent women in Texas Democratic politics: Wendy Davis and Leticia Van de Putte, two former state senators — Van de Putte is from San Antonio — who were the 2014 nominees for governor and lieutenant governor, respectively.

Waiting at the finish line of the Democratic primary is an increasingly well-positioned Hurd, who faces minimal opposition in his own nominating contest. Since his 2016 re-election, he has amassed a $1.2 million war chest and built a national profile as a rising-star Republican willing to break with his party’s president, Donald Trump.

In recent months, both Democratic- and Republican-aligned polling has found Hurd’s popularity far outpacing Trump’s in the district. So while his Democratic opponents certainly have their beefs with him — chief among them is that his voting record is not nearly as independent as his image suggests — they appear to have found a more galvanizing target in the president for now.

We’ve discussed Gina Ortiz Jones before. She got into the race late and was behind originally in fundraising, but she’s been a machine since December, blowing right past Jay Hulings. None of the other candidates are near their weight class. Doesn’t mean they’ll finish in the top two, but they do have all the advantages going in. As for Will Hurd, he has certainly done what he can to position himself well, but I feel like he could be the Lincoln Chafee of 2018 – liked by the voters, to the left of his partymates, but still voted out by an electorate that wanted to send a message to his President. I imagine he won’t have too many restful nights this year.

The Socialists are coming

To a primary ballot near you.

The revolution will be down-ballot. Or such is the implicit promise of Franklin Bynum’s campaign for Harris County misdemeanor court judge. A 35-year-old former public defender, Bynum said he’s seen Houston’s criminal courts routinely railroad the poor into convictions that drive them further into poverty. Now, after nearly 10 years subject to the whims of conservative judges, he’s aiming to take the gavel for himself.

“Who are these courts being operated for? Right now, it’s the police, the bondsmen and the prosecutors, and people are just the raw material to be chewed up,” said Bynum, who’s running as a Democrat for Harris County Criminal Court at Law 8. Bynum’s platform includes expanding the use of personal recognizance bonds, waiving certain fees for the poor and reducing mandatory appearances, which he said are used only to “coerce” guilty pleas from defendants out on bail. “A democratic socialist judge would make the courts work for the people,” he said.

Bynum is one of at least 17 members of the Democratic Socialists of America (DSA) running for office in Texas in 2018, including candidates for the U.S. House and offices ranging from governor to county treasurer. The DSA, which now counts more than 30,000 members nationwide, has grown explosively since Trump’s election and boasts at least 10 chapters in Texas. The group tends to prioritize issues on the left edge of the Democratic Party, like single-payer health care and a $15 minimum wage. There’s no official candidate list, but the Observer reached out to DSA groups around the state to compile this running tally. (Not all the candidates have been endorsed by DSA.)

Some of the candidates, like gubernatorial hopeful Tom Wakely — who styles himself the “Berniecrat with a Panama hat” and lost a 2014 congressional bid by 20 points — face the sort of uphill climb usually found in the Himalayas. But others stand a fighting chance, said Rice University political scientist Mark Jones. Jones pointed to congressional hopefuls Derrick Crowe, in District 21, and Rick Treviño, in the always-competitive District 23, as viable primary challengers.

“With Treviño and Crowe, it’s sort of the mirror image of what we saw with the tea party,” Jones said. “The advantage the establishment candidates have is money, but the tea party’s shown us that sometimes money can lose to these grassroots activist campaigns.”

In District 23, which stretches from El Paso to San Antonio and is currently represented by moderate Republican Will Hurd, Jones said a left wing platform that plays well with primary voters might fall flat in the general election. Hillary Clinton carried the swingy district by 3.5 percent in 2016, and Hurd’s margin of victory was just over 1 percent. But Treviño, a San Antonio high school teacher, is bullish: “[District] 23 is always described as a conservative district where ideas like Medicare for All or a living wage will turn off voters; that is absolutely false,” he wrote in a Facebook message to the Observer. “Across the district, these ideas are resonating, especially Medicare for All.”

There’s a list of DSA candidates at the bottom of the story and on this Google doc, which includes statements from some of them. As the story notes, some of these folks have a clearer path than others. Bynum has no primary opponent, so he’ll rise or fall with the rest of the countywide slate here in November. Danny Norris in HCDE Position 6, Precinct 1, Chito Vela in HD46, the two Travis County judicial candidates – if they win their primaries, they’re in. Derrick Crowe has raised a decent amount of money but lags Joseph Kopser by a wide margin in that primary. A win in March by Crowe would be a big feather for the DSA’s cap. I’m much more skeptical about Rick Trevino, who has two well-funded and establishment-backed primary opponents, and is in a district that isn’t exactly conducive to blockwalking. It’s not just about fundraising, either – if you look at their campaign Facebook pages, Gina Ortiz Jones has more than three times as many followers as Trevino, while Jay Hulings has more than double his total. I don’t know what the best way is to measure “grassroots” support, but the measures I can find don’t corroborate the notion that Trevino has an underestimated level of backing. We’ll know for sure in a week.

On a side note, I’d observe that there’s less difference between the DSA position and the “establishment” position than you might think, at least on some issues. Look at what Bynum says about his priorities for the misdemeanor court he’s running for, then compare the judicial Q&As I ran for Harold Landreneau and Armen Merjanian. Bail reform – which is supported by the likes of DA Kim Ogg and Sheriff Ed Gonzalez – and finding alternatives to incarceration are pretty mainstream these days. Sure, there are some differences, and there are different priorities, but to a sizable degree a lot of it is about strategy and rhetoric, much as it is the case with the Tea Party and the “establishment” Republicans.

January 2018 campaign finance reports: Congress

Here are the Q2 finance reports, here are the Q3 finance reports, and here’s the FEC summary page for Democratic Congressional candidates in Texas. The Trib summarizes some of the highlights.

For many Texas congressional races, Wednesday was the most consequential day yet on the primary calendar.

That was the deadline for U.S. House and Senate campaigns to file finance reports covering the last three months of 2017. Those watching the races closely are sure to pore over the mishmash of donations and expenditures to separate viable candidates from the long shots.

And that weeding out process could be more intense than past years. Of the eight Texans in Congress who are not running for re-election, six waited until the fall to announce their decisions, prompting late scrambles for those open seats.

Over in the U.S. Senate, U.S. Sen. Ted Cruz, R-Texas, was easily outraised by his leading Democratic challenger, U.S. Rep. Beto O’Rourke, D-El Paso.

Texas is hosting the first statewide primaries of 2018 on March 6. Early voting begins on Feb. 20.

Here’s a Trib roundup of reports, which includes Republicans. I only looked at the Dems, and there were a few candidates who didn’t have any to see as of Saturday, so those folks are not represented above. Here are a few thoughts:

– Damn, this is a lot of money being raised. As I observed before, in 2016 there was only one Democratic non-incumbent who raised as much as $100K over the course of the cycle. With nearly a year to go in this cycle, eighteen candidates have topped that mark, with four others above $70K. Republicans are still going to lead the money race in most districts, but there’s no reason why any Democratic candidate must be outclassed.

– There’s about to be a lot of money spent, too. All four of the top raisers in CD07 are or are about to be airing TV ads, and they have been sending mail, too. We’ll see the scope of this in the next report, for which the deadline is March 31, after the primary is over.

– While there’s a lot of money in the Republican primary for CD02 – Kathaleen Wall has given her campaign some $2.7 million – Todd Litton has raised more from actual donors than any of them.

– In my previous update, I noted that Gina Ortiz Jones hadn’t had much time to do any fundraising. She had a pretty good Q4, though that was effectively even with Jay Hulings. She did demonstrate she has the chops, which was what mattered.

– For all the money that has been raised overall, I feel like Dems are not maximizing their potential as yet. We could use more resources in CDs 03, 06, 10, 22, and 24. Sure, most of these races are longer shots, but the point is that if this is a strong year for Dems, the margin between winning and losing in a district like those could be whether or not the challenger has enough resources to put up a real fight. There are going to be a number of people who wake up on March 7 as former candidates and who will still have six figures in the bank. I would strongly encourage these people to redirect some of their campaign cash to the nominees in other districts. Trickling some of it down to the state races would not be a bad idea, either.

More on the national wave of female candidates

As the second Women’s March was taking place yesterday, there were stories in two national publications about the plethora of women running for office this year. Here’s TIME Magazine:

Erin Zwiener returned to Texas to settle down. At 32, she had published a children’s book, won Jeopardy! three times and ridden roughly 1,400 miles from the Mexico border up the Continental Divide on a mule. In 2016, she moved with her husband to a small house in a rural enclave southwest of Austin with simpler plans: write another book, tend her horses, paint her new home blue.

One day last February, she changed those plans. Zwiener was surfing Facebook after finalizing color samples for her living room–sea foam, navy, cornflower–when she saw a picture of her state representative, Jason Isaac, smiling at a local chamber of commerce gala. “Glad you’re having a good time,” she commented. “What’s your position on SB4?” After a tense back-and-forth about the Lone Star State’s controversial immigration law, Isaac accused her of “trolling” and blocked her. That’s when she decided to run for his seat. Zwiener never got around to painting her living room. She’s trying to turn her Texas district blue instead.

Zwiener is part of a grassroots movement that could change America. Call it payback, call it a revolution, call it the Pink Wave, inspired by marchers in their magenta hats, and the activism that followed. There is an unprecedented surge of first-time female candidates, overwhelmingly Democratic, running for offices big and small, from the U.S. Senate and state legislatures to local school boards. At least 79 women are exploring runs for governor in 2018, potentially doubling a record for female candidates set in 1994, according to the Center for American Women and Politics at Rutgers University. The number of Democratic women likely challenging incumbents in the U.S. House of Representatives is up nearly 350% from 41 women in 2016. Roughly 900 women contacted Emily’s List, which recruits and trains pro-choice Democratic women, about running for office from 2015 to 2016; since President Trump’s election, more than 26,000 women have reached out about launching a campaign. The group had to knock down a wall in its Washington office to make room for more staff.

It’s not just candidates. Experienced female political operatives are striking out on their own, creating new organizations independent from the party apparatus to raise money, marshal volunteers and assist candidates with everything from fundraising to figuring out how to balance child care with campaigns.

That story also quotes Lina Hidalgo, the Democratic candidate for Harris County Judge. I’ll get back to it in a minute, but first here’s The Cut, which is part of The New Yorker.

To date, 390 women are planning to run for the House of Representatives, a figure that’s higher than at any point in American history. Twenty-two of them are non-incumbent black women — for scale, there are only 18 black women in the House right now. Meanwhile, 49 women are likely to be running for the Senate, more than 68 percent higher than the number who’d announced at the same point in 2014.

To name-check just a fraction of these newly hatched politicians, there’s Vietnam-born Mai Khanh Tran, a California pediatrician and two-time cancer survivor vying for a House seat that’s been held by Republican Ed Royce for 13 terms. There’s military wife Tatiana Matta, who’s one of two Democrats trying to oust House Republican Majority Leader Kevin McCarthy, and Mikie Sherrill, a former Navy pilot and federal prosecutor, who hopes to show New Jersey representative Rodney Frelinghuysen the door. (Twenty-three-year congressional veteran Frelinghuysen is descended from a family once ranked the seventh-most-powerful American political dynasty: His father was a congressman, his great-great-grandfather and great-great-great-uncle were senators; his great-great-great-great-grandfather — also a senator — helped to frame New Jersey’s Constitution.)

Of course, in most fields, altering power ratios is neither swift nor easy. Even if men are pushed from their lofty perches, those waiting to take their places, the ones who’ve accrued seniority, expertise, and connections, are mostly men. Women who’ve been driven out or self-exiled from their chosen professions often cannot simply reenter them — as partners or managers or even mid-level employees.

This is one of the relative virtues of politics: It can be swiftly responsive to change. You can, in theory, run for local or state or even federal office, even if you’ve never been as much as a student-council secretary. If you’re a preschool teacher or a law professor or a sanitation worker, there will be substantial obstacles, yes — weaker networks, fund-raising disadvantages; party machinery, institutional obstruction, and identity bias to push past. Yes. But you can run. And if you win, whether the office is small or large, you might be able to shake things up. The people who control state and local legislatures often determine who in their communities gets to vote easily, who has access to health care or to legal sanctuary; local governing bodies around the country have in recent years passed legislation for paid leave and paid sick days and higher minimum wages.

It’s certainly true that the policies that are enacted depend on which women run and win — the country is full of Sarah Palins, not just Elizabeth Warrens. According to the Rutgers Center for American Women and Politics, however, so far it’s the Warrens who are getting into the game. Of the 49 women currently planning to run for the Senate (including incumbents, challengers, and those running for open spots), 31 are Democrats. Well over half of the 79 women slated to campaign for governor are Dems, as are 80 percent of the women setting their sights on the House.

This past fall’s elections — in which Danica Roem, a 33-year-old transgender woman, handily beat an incumbent who’d authored a transphobic bathroom bill and dubbed himself the state’s “chief homophobe”; in which Ashley Bennett, a 32-year-old psychiatric-emergency screener from New Jersey bumped off the Atlantic County freeholder who’d mocked the Women’s March by asking whether protesters would be home in time to cook his dinner — showed that improbable wins by improbable candidates are possible, perhaps especially if they can convert anger and frustration at the ways in which they’ve been discriminated against into electoral fuel.

This one has a companion piece that lists ten women to watch for. Two of them are by now familiar names from Texas: Laura Moser and Gina Ortiz Jones. The bit about Moser notes that she has Lizzie Fletcher as a primary opponent, and if you look at the embedded image, taken from the main story, you’ll see three of their pictures. Moser and Fletcher, along with Hidalgo, are on the TIME cover. I am as always delighted to see our candidates receive attention, but I wonder a little about how the decision is made about on whom to focus. Moser, Fletcher, and Jones are all strong candidates with good stories and fundraising to match, but as I noted before, the women who are most likely to make it to Congress from Texas are Sylvia Garcia and one of Veronica Escobar and Dori Fenenbock, none of whom have received a tiny fraction of the love from the press. I mean, there’s a non-trivial chance none of the three Texans in the Cut picture will be on the ballot in November – only two of them can be no matter what – and a larger chance none of them will get sworn in if they are. Maybe it’s because the three I’m noting are all current officeholders, though in that Cut companion piece three of the ten women featured are incumbents of some kind and one or two others are former Obama administration officials. I get that the women had previously been less engaged with the process are now the biggest part of the story, I just feel like the amount of attention they’re getting relative to what those who had been there before are getting is a bit skewed. It’s not that big a deal – I strongly suspect that once Sylvia Garcia is the nominee in CD29, possibly joined by Escobar in CD16, there will be a flurry of articles about the first Latina member(s) of Congress from Texas. It was just something I thought about as I read these. You should read them, too.

I do love national stories about our Congressional candidates.

Gina Ortiz Jones thought she could work for President Donald Trump.

When he won the presidency in November 2016, Jones, a career civil servant who served in the Air Force in Iraq under George W. Bush and as an intelligence officer under Barack Obama, stayed in her job as a director in the Office of the U.S. Trade Representative. But by June, she couldn’t do it anymore. Trump’s plans to gut education and housing aid hit too close to home for Jones, as someone who relied on reduced-cost school lunches and subsidized housing when she was a kid being raised by a single mom in San Antonio. She was also appalled by the president’s hires for top jobs.

“The type of people that were brought in to be public servants were interested in neither the public nor the service,” Jones, 36, said in an interview. “That, to me, was a sign that I’m going to have to serve in a different way.”

She found a new way to serve: She’s running for Congress. Jones has never run for office before, and if she wins, she would make history as the first lesbian, Iraq War veteran and first-generation Filipina-American to hold a U.S. House seat in Texas. Her hometown district, Texas’ 23rd, has also never been represented by a woman.

Jones wouldn’t have been able to grow up healthy or get an education without the opportunities she got from the federal government, she said. The only reason she could afford college, she added, was that she got a four-year Air Force ROTC scholarship — and it infuriates her to see politicians try to take away those chances for others.

“Talent is universal. Opportunity is not,” she said. “Folks in Congress, they do three things. They create opportunities, they protect opportunities and they erase opportunities. That’s how we have to be thinking about this very plainly.”

Jones expressed frustration that [incumbent Rep. Will] Hurd routinely votes against his constituents’ interests but seems to get away with it because of his reputation for being “the nice guy.” Last year, Hurd gave people warm fuzzies about bipartisanship by live-streaming a 1,600-mile road trip with Texas Democratic Rep. Beto O’Rourke. HuffPost thought it looked fun (even if it was a political calculation by O’Rourke, who proposed the trip and announced a Senate run weeks later). Jones scoffed.

“When bipartisanship means two dudes get in a car and help each other get elected, we’re all fucking screwed,” she said.

Instead, Jones ran through Hurd’s record. He voted to delay the implementation of smog reduction measures by eight years, despite 1 in 13 Texans having asthma (with even higher rates in communities of color, like his). He voted nine times to repeal the Affordable Care Act. He voted for the GOP’s tax bill, which benefits the rich and raises taxes on middle-class families over time. He’s been quiet about Congress’ failure to renew funding for the Children’s Health Insurance Program, which is set to expire and would affect 400,000 kids in Texas.

It’s particularly outrageous that Hurd hasn’t signed onto a bipartisan bill, the Dream Act, to preserve the Deferred Action for Childhood Arrivals program, Jones said. Trump ended the program in September, and young undocumented immigrants will begin losing protections in greater numbers in March unless Congress passes a law to keep it. If lawmakers fail to act, hundreds of thousands of young undocumented immigrants are at risk of being deported.

Jones said the uncertainty around DACA is “a huge deal” in Texas’ 23rd District, where more than 70 percent of constituents are Latino.

“So I push back on the fact that some say, ‘Oh, he’s not that bad.’ His voting record is awful,” she said. “You don’t get to be a moderate just because you don’t say crazy shit.”

I’ve always kind of admired candidates who are willing to cuss on the record. I also think that’s the right way to attack Hurd, whose moderate reputation is based in large part on sounding less extreme than his colleagues. As noted before, Jones has a tough fight in the primary before she gets to take on a tough fight in November. She’s picked up a lot of establishment support, and I hope to see that reflected in her Q4 finance report. If she does win the primary, she’ll have a very high profile going forward. Keep an eye on her.

How many more women are we likely to have in Congress next year?

Probably at least two, and more are possible.

No freshman woman has come to Congress from Texas since Granger’s election 1996, with the exception of former U.S. Rep. Shelley Sekula Gibbs, who served as a placeholder for less than two months in late 2006. (Hutchison, who left the Senate in 2013, is now U.S. ambassador to NATO.)

The problem in Texas was not so much that women weren’t winning – it was that they weren’t running.

In interviews with candidates, officeholders and campaign consultants, the most-cited reasons for the lack of female candidates were concerns that gerrymandered districts would protect incumbents, an aversion to commuting to Washington while raising children and general apathy, a problem Jackson Lee cited back in 2016.

That all changed this year, in part due to a national backlash against Trump on the Democratic side and, in Texas, a wave of retirements on both sides.

Approximately 50 women have lined up this year to run for Congress in Texas, among hundreds running around the country. Of that sum, a handful are running well-funded, professional campaigns and have viable paths to serving in Washington.

Former El Paso County Judge Veronica Escobar and former El Paso School Board President Dori Fenenbock are the best-funded candidates aiming to succeed O’Rourke, and former state Rep. Norma Chavez threw her hat into the ring just before the December filing deadline. Escobar and Fenenbock both cited the same reason as contributing to their decisions to run: Their children are old enough that they felt comfortable making the Washington commute without creating disruptions in their families.

Three men are also running in the Democratic primary, but the betting money among political observers is on El Paso sending a woman to Washington.

Another potential future congresswoman is state Sen. Sylvia Garcia, a Houston Democrat who is seeking retiring U.S. Rep. Gene Green’s 29th District seat and has drawn Green’s endorsement. She faces a crowded field in a Democratic primary that will likely determine the outcome of the election. Houston political insiders say that, while there are no assurances, Garcia is in the driver’s seat for the nomination.

She ran for Congress previously in 1992 against Green and lost. Back then, she was part of another crush of women entering politics, at that time in response to the controversial Clarence Thomas Supreme Court hearings.

On the GOP side, Texas women running for open seats in Congress include political fundraiser Bunni Pounds and communications consultant Jenifer Sarver. Both women are in ferociously competitive primaries.

Pounds is running in CD05, the only woman among nine candidates. Sarver is in the 18-candidate pileup in CD21; there are two other women alongside her. I suppose you could add Kathaleen Wall in CD02 to this list as well. She’s the sole woman in that eight-contestant field, and she’s already advertising on TV, with a spot during the college football playoffs last week. Here’s my subjective ranking of the odds for each of these hopefuls.

1. Sylvia Garcia – She doesn’t appear to have any notable opposition, though one of her opponents has raised some money. If she wins the primary she’s a shoe-in for November. Frankly, I’ll be shocked if she’s not the winner in CD29.

2. Escobar/Fenenbock/Chavez – Like CD29, the primary winner has a cakewalk in November. There’s a non-zero chance that any or all of these women could fail to make the primary runoff, so I put their collective odds below Garcia’s.

3. Bunni Pounds – As with the others, she’s a lock if she wins the primary, but she has a tougher road to get there.

4. Gina Ortiz Jones – I originally had her lower than Wall and Sarver, but Dems are currently more favored to win here than the GOP is in CDs 02 or 21, and I figure she’ll be in a runoff with Jay Hulings, while neither Wall nor Sarver has as seemingly clear a path to May. Ask me again after I see the Q4 finance reports; Hulings outraised Jones in Q3 but he was officially in the race before her. We’ll see how she does with an equal time period.

5. Jennifer Sarver – The Republican candidate will be favored in CD21, but it’s not a lock. Sarver has to get through the primary first, and with that many candidates it’s like ping pong balls in a lottery machine.

6. Kathaleen Wall – You could swap Wall and Sarver without much argument from me. I think Dems have slightly better odds to win CD02, but Wall has fewer opponents in the primary, so it kind of balances out.

7. Lizzie Fletcher/Laura Moser – It’s a tough primary in CD07 and a coin flip in November, but if either of these women can make it to the November ballot she’ll have a decent shot at it.

8. The rest of the field – Lillian Salerno in CD32, Jana Sanchez and Ruby Woolridge in CD06, Letitia Plummer in CD22, Lorie Burch in CD03, Jan McDowell in CD24, Silky Malik in CD02, MJ Hegar in CD31, etc etc etc. The over/under is set at two for now, but there is a scenario in which the number of female members of Congress from Texas increases by a lot.

Thoughts going into primary season

So primary season is officially open, with candidates pretty much everywhere. I’ve been busy doing interviews and will cover as many Democratic races as I can, but won’t get to them all. I may double back in the runoffs, we’ll see. In the meantime, here are my thoughts as we begin.

1. Let’s take a minute to appreciate the depth and breadth of the candidate pool. It’s not just that there are so many people running and that so many offices have candidates competing for them, it’s that so many of these candidates reflect a diverse array of backgrounds, talents, and experiences. In every way, we’ve never seen anything like this before.

2. That said, there are a few duds out there – Lloyd Oliver in HD134 is the most prominent local loser. The good news is that unlike 2014, there are no Jim Hogans or Grady Yarbroughs running in the statewide races where a low profile can enable them to sneak through. Hogan is running for Ag Commissioner in the Republican primary this year (LOL), and Yarbrough is buried in the gubernatorial race. Some candidates are better than others in the downballot primaries, but as far as I can tell none of them look like embarrassments.

3. Still, it’s on all of us to ensure that the best candidates make it through. That starts with the candidates themselves, all of whom need to take the primary seriously, but we’re the ones that get to choose. We need to do our homework.

4. Let’s talk about that diversity for a minute. Having looked at the web and Facebook pages of all the State Senate and most of the Congressional candidates, I’ve seen:

– Quite a few LGBT candidates – Mark Phariss and Fran Watson for State Senate; Lorie Burch and John Duncan and Mary Wilson and Gina Ortiz Jones for Congress. I’m sure I have missed some, and that’s before considering State House contenders.

– Doctors, scientists, software engineers, teachers, the non-profit sector, at least one locksmith. Basically, a lot more than just your usual lawyers, businessfolk, and political types.

– Military veterans, from all four branches of service.

– People of color running in districts that were not specifically drawn to elect a person of color. Not too surprising, given that we’re talking about people running in Republican districts, but still at a higher rate than in past years. With Sylvia Garcia running in CD29, we are very likely to elect our first ever Latina member of Congress, and if Veronica Escobar wins in CD16, we’ll elect our second as well. Gina Ortiz Jones, whose family is from the Philippines, has a decent chance of being our first ever Asian-American member of Congress. On the flip side of that, if Democrats make gains in the suburbs that could well increase the legislative presence of Anglo Democrats, of which there are currently (I think) six all together.

– Lots of younger candidates. Everyone in CD07 is younger than I am. I didn’t spend too much time dwelling on this lest I fall into a “What have I done with my life?” rabbit hole, but there’s a lot of youthful energy out there.

5. The more I think about it, the more I believe that strong turnout in the primary will be important going forward. First and foremost, a big showing in the primary will ensure that the narrativeis about Democrats being engaged and involved, and that this year really is unlike previous years. As we know, Dems topped one million primary voters in 2002, and haven’t come close to it in a non-Presidential year since then. Reaching one million in 2018 would be a positive sign. Reaching 1.5 million, which would be higher than the 2010 and 2014 Republican primaries, would really open some eyes. My hope is that all those Ylocal and legislative races will draw people out, but it wouldn’t hurt for the Beto O’Rourkes and Lupe Valdezes and Andrew Whites to do their part and spend some money getting people to the polls.

6. As much as we celebrate the vast number of candidates running this year, we also need to come to terms with the fact that the vast majority of them will lose. Most of them, in fact, won’t make it to November at all – this is the obvious consequence of having so many multi-candidate primaries. Given the talents and experiences of these candidates, it would be a shame if most of them wind up being one-and-done with elected office. Most people don’t win their first race, and sometimes losing a race just means that the time wasn’t right for that candidate. It’s very much my hope that a decent number of the people who fall short come back to try again. That can mean a second try at the same office in 2020, and it can mean some other office. Again, many elected officials got there on their second or third or even fourth attempt. Learn from the experience, keep building relationships, and find another opportunity in the future.

7. Of course, there are other ways to contribute beyond another run for office. Organize, advocate, fundraise, network, mentor – the list goes on. 2016 was a wakeup call for a lot of people. We don’t get to go back to sleep regardless of whether things go as we’d like in 2018.

8. But we do think 2018 will go our way, and if that’s the case we should act like it. What I mean by that is that the organizations that back candidates in competitive districts need to expand their vision, and their supporting capabilities, beyond that horizon. Set some stretch goals, and work to meet them. Find candidates running against the really bad actors, even in “unwinnable” districts, and support them, too. Annie’s List, labor, Equality Texas, the DLCC and more, I’m talking to you. Examples of such candidates: Kendall Scudder, running (most likely) against Sen. Bob Hall; Lisa Seger, running against Rep. Cecil Bell; Yolanda Prince, running against Rep. Matt Schaefer. If we want good people to run in these districts, the least we can do is not leave them hanging.

I was browsing around Facebook and came across a link to this 2018 midterm forecast from The Crosstab, whose proprietor also works at Decision Desk. As such, it is basically a December update to the November Decision Desk forecast, which is nice because it allows us to make direct comparisons. As before, it has a table containing numbers for each Congressional race, so as before let’s take a look at the relevant ones for Texas:

I added the “Nov Prob” column to compare the Democrats’ win probability as given in this December article to the win probability in November. In all cases, it has improved over the last month, mostly as the approval ratings for Donald Trump continue to sink and the generic Congressional preference polls favor Dems more strongly. The single biggest change is in CD06, thanks to the nude photo-fueled retirement of Smokey Joe Barton. The overall numbers may continue to move in a Democratic direction, they may plateau, they may fluctuate, it’s hard to say. But as long as these updates keep coming out, we can at least track them.

You may wonder why the percentage of the vote Hillary Clinton received in 2016 is greater than the projected Democratic percentage in 2018 in CDs 07 and 32. I’d say the main reason for that is that Clinton ran so far ahead of the baseline in those districts, picking up numerous Republican crossover votes. What those folks may do in 2018 is a bit of a mystery, and will likely be dependent to some extent on who the nominees are in those districts. Still, CD07 is now ever so slightly tilted towards the Democrats, with CD02 on the verge of following. The numbers look so good even I have a hard time really believing them. We’re still talking a coin flip, of course. It will be easy to begin to think that these races are in the bag – I already see people on Facebook posting as if Dems had all but already won in CD07. These races are and will be hard and expensive, and there are absolutely no guarantees. What we have is opportunity. What we do with it is up to us.

So long, Smokey Joe. Hope to see a whole lot less of you from here on out. There are, I kid you not, eleven Republican candidates vying for this seat, and it could have been thirteen but two hopefuls had their applications rejected. Lord only knows what will happen on that side. I have mentioned the five Democratic candidates before, back when we were first learning about Smokey Joe’s peccadilloes. Decision Desk had this as only a 15% chance of a pickup in November, but that was pre-scandal and retirement. Those odds are better now.

Jana Lynne Sanchez has been a political consultant and fundraiser, and worked as a journalist after that. She’s a Rice graduate and an aspiring country singer. If she makes it to Congress, maybe she can collaborate with Sen. Orrin Hatch. Ruby Faye Woolridge is a retired educator who has run for office several times, including for CD06 in 2016. Levii Shocklee is a Navy veteran who doesn’t tell us much else about his biography. Justin Snider is a locksmith and served as a national delegate for the Bernie Sanders campaign in 2016. John Duncan works for the largest local non-profit HIV/AIDS service organization in North Texas.

CD21

Boy, you only think there’s a cattle call for the Republican nomination in CD06. There are eighteen – EIGHTEEN! – Republicans that have filed to fill Lamar Smith’s pollution-loving immigrant-hating shoes. They include Chip Roy, former Chief of Staff to Ted Cruz; Jason Isaac, the State Rep. in HD25; Quico Canseco, who lucked into a term as Congressman in CD23 in the 2010 wave; Susan Narvaiz, a three-time loser to Rep. Lloyd Doggett in CD35, and fourteen more. One way to look at this is that is the vote were to be split evenly among all the contenders, they’d each get about 5.6%. Fifteen percent may well be enough to make it to the runoff. There’s a non-zero chance that the nominee could be some random nobody. Which makes it all the more important that the Democratic candidate is someone who has an A game to bring in a district pegged at a 43.4% win chance and 49.0% performance.

This race is interesting and worth watching on just about every level, and that begins with the primary. Joseph Kopser is an Army veteran and businessman who made news for out-fundraising Lamar Smith back in Q2. He’s also racking up endorsements – Garry Mauro, House Democratic Whip Rep. Steny Hoyer, Bexar County Judge Nelson Wolff, as well as nonprofit STEM organization 314 Action – and can fairly be characterized as the establishment candidate. Derrick Crowe, who has been a senior staffer on Capitol Hill and now works in the nonprofit sector, also has an impressive array of endorsements including Our Revolution, Democracy for America, and the UT University Democrats. He was the first Democrat I heard of in this race, citing Smith’s terrible environmental record as his inspiration to run. And then there’s Elliott McFadden, the Executive Director of Austin B-Cycle and past Executive Director of the Travis County Democratic Party, who has his own set of endorsements, and Mary Wilson, a math teacher and minister. They all look like terrific candidates, so my main hope at this point is that the primary doesn’t get too nasty.

Here’s a list of Congressmen from CD23 since 2002:

And there’s a 69.2% chance (according to Decision Desk as of November) that we’ll have another person in there next year. After that who knows – this district was ruled illegal by the federal district court and could be redrawn for 2020, and regardless of that it will be redrawn again for 2022. You know what they say about change being the only constant? This district is the poster child for that.

Gina Ortiz Jones served in Iraq as an Air Force intelligence officer, and continues to work in national security, intelligence, and defense. She’s one of several female veterans running for Congress as Democrats this cycle – note that article doesn’t appear to count MJ Hegar, so it is necessarily incomplete – and has racked up an impressive array of endorsements, from Emily’s List and Vote Vets to the Asian American Action Fund and the Victory Fund. Jay Hulings is a former federal prosecutor and has served in the House as Counsel to the House Intelligence Committee and Legislative Director to former Rep. Jane Harman. Judy Canales was appointed by President Obama in 2013 to be the Texas State Executive Director for the USDA Farm Service Agency. Rick Trevino is a teacher and Secretary of the Bexar County Democratic Party who served as a national delegate for Bernie Sanders in 2016.

I’ve covered other Congressional races in the Harris County and surrounding county writeups, and of course there’s great interest in CD16 to succeed Beto O’Rourke, but that race will be decided when the primary winner emerges. I’m busy doing interviews in CDs 07 and 02, and we’ll see how much more I wind up doing. Again, it is important for all of us to know who our candidates are and to pick the best one to represent us, on the ballot and hopefully in Washington. I hope this has been useful for you.

Republicans are worried about Culberson

They should be, though I bet they wish they didn’t have to be at this point in the cycle.

Republican strategists are warning that some of the party’s veteran House incumbents aren’t adequately preparing for the 2018 election, putting the GOP majority at risk by their failure to recognize the dangerous conditions facing them.

Nearly three dozen Republicans were outraised by their Democratic challengers in the most recent fundraising quarter. Others, the strategists say, are failing to maintain high profiles in their districts or modernize their campaigns by using data analytics in what is shaping up as a stormy election cycle.

“There are certainly incumbent members out there who need to work harder and raise more money if they want to win,” said Corry Bliss, executive director of the Congressional Leadership Fund, the House GOP’s top super PAC. “They’re fundamentally not prepared for how they’re about to be attacked.”

Bliss declined to identify specific members who appear to be lagging, but the super PAC’s recent actions speak loudly. CLF recently opened new field offices in the districts of Texas Rep. John Culberson and New Jersey Rep. Leonard Lance, both veteran incumbents who have cruised to reelection without serious opposition in recent years. But Culberson and Lance have raised less money than any Republicans running for reelection in Clinton districts, alarming GOP strategists.

“We’re trying to do a better job in fundraising,” Lance said in an interview. “We’re something like 55 percent ahead of where we were at this time two years ago, and we’re doing a better job, and obviously [we] want to continue with that.”

Lance said the recent gubernatorial and legislative elections in New Jersey made fundraising “a tad bit more difficult” this year. But his campaign also noted that Republican Lt. Gov. Kim Guadagno still carried Lance’s district in the governor’s race despite losing statewide by double-digits.

Culberson, who outspent his 2016 Democratic opponent roughly 20-to-1 but won just 56 percent of the vote, was outraised in the most recent quarter by two Democratic challengers.

“Culberson’s problem — and other congressmen like him — lies more with motivating their own base, because if they can’t deliver their own conservative agenda, it’s 100 percent a problem for them,” said Luke Macias, a Republican consultant based in Texas.

“A lot of people feel like he’s not as connected to his district and he doesn’t spend as much time there as he could,” Macias said. “That’s a common criticism from political activists, Republican and Democrat, across the board.”

Democrats say it’s a sign of GOP weakness to have the super PAC showing up in their neighborhood the year before the election.

“It reflects that this district is looking for new leadership and Republicans have a reason to be worried,” said Alex Triantaphyllis, one of the Democratic challengers who outraised Culberson last quarter. “Culberson has not been engaged with this community … he’s focused more on upholding national Republican ideology.”

“A lot of people feel like he’s not as connected to his district and he doesn’t spend as much time there as he could”. Oy. And that’s what a Republican is saying. To be fair, the DCCC has an organizer on the ground in CD07 as well, so in some sense this is just parity. The CLF also has a presence in CD23, which is a swing district in any cycle. And there’s some very early polling evidence to suggest that Culberson will need all the help he can get. I hope that when all is said and done we at least get a decent account of what did and didn’t work to generate votes in this district.

Early Congressional odds

The 2018 House Midterm Election is bound to be one of the more interesting in recent memory. With Donald Trump in the White House, infighting on both sides of Congress, and an American public that is bursting at the seams we have a recipe for a perfect political storm. Keep your eye on this page, which houses our forecasts for all 435 congressional districts, and stick with us as we attempt to answer the ultimate questions: who will win majority control of the US House of Representatives?

The Democratic Party is ahead in generic ballot polls up 7.1% in our average. They hold an 8.2 percentage point lead in our projection of the election day two-party vote.. We get all of our polling data from Huffington Post Pollster, which you can investigate here.

But, because Democrats are clustered in cities and face harsh gerrymanders, they aren’t expected to win an equivalent share of the seats in Congress. What does electoral geography tell us about the actual outcome?

Democrats earn a median of 218 seats in our simulations of the 2018 midterms. This may differ from the strict predictions below because of the larger number of Lean Republican seats than Lean Democratic seats in the current Congress. Effectively we are saying that the below number is an ideal estimate, meant to give you context as to which seats are competitive, but that we expect Democrats to overperform expectations based on the assessment of our error in past predictions.

Note that latter entry is from August, when Dems had about a four percent lead in the generic Congressional ballot, and the model predicted a gain of nine seats, well below the amount needed to retake the majority. Things have improved considerably for them since then, and it shows up in the probabilistic model for each district. Farther down in the original link above is a table highlighting the relevant data and odds of a D victory in each district. I’ve cut out the relevant info for Texas. Feast your eyes:

Kind of amazing, isn’t it? One Dem takeover favored, three tossups, and four more seats for which the odds are around one in four. That was before the Joe Barton nude photos scandal, and who knows what effect that could have. CD02 is rated much more highly as a pickup opportunity than CD32, likely due to Ted Poe’s retirement. As the authors take pains to note, this kind of forecast provides a range of outcomes, and some amount of error is to be expected. Such errors are likely to go exclusively in one direction, and things can change quickly. We’ll need to keep an eye on this going forward – I expect there will be updates about once a quarter – but if there’s a main takeaway, it’s that we really need good candidates in every race. We have them in most districts, but there are a few that could still use an upgrade. There’s a ton of opportunity here, we need to be in a position to grab it.

Opinions differ about Congressional prospects

I’m gonna boil this one down a bit.

Moments before the polls closed in Virginia’s Democratic sweep, Houston-area Republican Ted Poe, across the Potomac River on Capitol Hill, announced his retirement in 2018 after 14 years in Congress.

Poe cast his move Tuesday night as a personal decision: “You know when it’s time to go,” he told the Chronicle. “And it’s time to go, and go back to Texas on a full-time basis.”

But a wave of retirement announcements from Texas Republicans in both Congress and the Legislature already had sparked a lot of speculation that the pendulum of power might swing against the GOP, even possibly to some degree in a deep red state like Texas.

Poe and other Republicans dismissed that notion, arguing that their prospects in 2018 are strong, particularly in the Senate, where 10 Democratic incumbents face the voters in states won by President Donald Trump.

Democrats, however, celebrated Ralph Northam’s victory over Republican Ed Gillespie in Virginia’s hard-fought governor’s race as the start of an anti-Trump wave that could only grow as the president’s approval ratings continue to sink.

However coincidental, Poe’s announcement – following those of Texas U.S. Reps. Lamar Smith, Jeb Hensarling and Sam Johnson – seemed to add to the buzz.

Democratic hopeful Todd Litton, a nonprofit executive in Poe’s district, has raised more than $256,000 for the race, outpacing Poe’s fundraising in the three-month period between April and June.

Poe, however, called the suggestion that he is running away from a tough reelection “nonsense.” He noted that he won reelection last year with 61 percent of the vote, a substantially better showing than Trump, who won 52 percent of the district’s vote for president.

“I don’t appeal to people on the party label,” said Poe, a former teacher, prosecutor and judge. “I appeal based on who I am.”

David Crockett, a political scientist at San Antonio’s Trinity University, said the question lingering after Virginia’s election results: Is this the beginning of something different?

“Texas is still pretty red, but the result of all these retirements could be opportunity for a Democrat in the right circumstances,” he said. “It’s always easier for an opposition party to pick off an open seat … but I still think we’re a decade away from any significant change.”

Texas Democrats, for the most part, have their sights set on Hurd, Sessions and Culberson, whose districts went to Clinton in 2016. Recent internal polling also has bolstered their hopes of flipping the suburban San Antonio district where Smith is retiring.

Around Houston, it would take a pretty big wave for Poe’s 2nd Congressional District to fall into the Democratic column, but in the current political climate, some analysts say, who knows?

“I wouldn’t go to Las Vegas and bet on it,” said Craig Goodman, a political scientist at the University of Houston in Victoria. “But every election cycle, there’s always one or two districts where you’re like, ‘Wow, how did that happen?’ Maybe the 2nd would be that district.”

CDs 02 and 21 were more Democratic in 2016 than they were in 2012, and the retirements of Ted Poe and Lamar Smith will make them at least a little harder to defend in 2018 than they would have been. They’re not in the same class as CDs 07, 23, and 32, but a sufficient wave could make them competitive. Another factor to keep in mind is who wins the Republican primaries to try to hold them? Some candidates will be tougher than others, and in this day and age it’s hardly out of the question that the winner in one of these primaries could be some frothing Trump-or-die type that no one has heard of who might have trouble raising money and turn voters off.

There’s another point to consider, which is that some of the candidates who run for these now-open Congressional seats may themselves be holding seats that would be more vulnerable without an incumbent to defend them. For instance, State Rep. Jason Issac has announced his candidacy in CD21. Isaac’s HD45 went for Trump by less than five points and with under 50% of the vote; it was typically more Republican at the downballot level, but still shifted a bit towards the Dems from 2012 to 2016. Erin Zwiener is the Democratic challenger in HD45. As for CD02, it is my understanding that State Rep. Kevin Roberts, the incumbent in HD126, is looking at CD02. HD126 was about as Republican in 2016 as CD02 was, so if Roberts changes races that will open up another Republican-favored-but-not-solid seat. We’ll know more when the filings come in, but that’s what I’d keep my eye on. Candidates matter, and the Dems have been rounding them up for months now. Republicans are just getting started in these districts. They have less margin for error.

October campaign finance reports: Congress

Here are the Q2 fundraising reports for Texas Democratic Congressional candidates. I’ll sum up the data below, but here’s the Trib with some highlights.

After Democratic challengers outraised four Texas Republicans in Congress earlier this year, some Republicans recaptured fundraising momentum in the third quarter – but not all of them.

Campaign finance reports for federal candidates covering July through September were due on Saturday. The reports show signs of of Democratic enthusiasm continuing, though U.S. Reps. Pete Sessions of Dallas and Will Hurd of Helotes, both Republicans, posted strong third quarters.

U.S. Sen. Ted Cruz, R-Texas, barely outpaced his challenger, U.S. Rep. Beto O’Rourke, D-El Paso, and two GOP congressmen saw Democratic challengers raise more money.

Hurricane Harvey may have depressed fundraising overall, with many incumbents and challengers posting lukewarm quarterly hauls.

“I don’t think it’s appropriate and certainly not tasteful to raise money from people who’ve been devastated and lost everything,” said U.S. Rep. John Culberson, a Houston Republican who was outraised by two of his Democratic challengers.

Democratic numbers were also smaller, suggesting candidates who announced earlier this year picked off the low-hanging donors in their previous campaign reports. And candidates who entered races only recently had less time to raise money.

But also, there was a larger dynamic at work. Ali Lapp is the operative who oversees the super PAC that supports Democratic House candidates, said donors are holding back from challengers because of the crowded nature of the Democratic primaries.

“With so many good Democratic candidates running in primaries, it’s no surprise that many Democratic donors are waiting to give direct candidate donations until after the field shakes out a bit, or even until after the primary is concluded,” she said.

The Chron focuses in on CD07, which has the largest field and the most money raised so far. We’ve seen the aforementioned dynamic in other races, where some people and groups want to wait and see who the frontrunners or runoff participants are before jumping in. The danger is that the candidate or candidates you like may not then make it into the runoff, but that’s a bit esoteric right now. The fact remains that we haven’t had this level of activity in Democratic Congressional primaries since Dems were the dominant party in the state. That’s pretty cool.

Notes:

– Unlike other campaign finance reports, the FEC reports are cumulative, which is to say that the numbers you see for Raised and Spent are the totals for the entire cycle. For all the other races we look at, these numbers represent what was raised and spent in the specific period. It’s useful to have these totals, but you have to compare to the previous quarter if you want to know how much a given candidate raised or spent in that quarter.

– There are eight candidates in this summary who were not in the Q2 roundup – Khorasani, Escobar, Hulings, Ortiz Jones, Panda, Hegar, Lester, and Salerno. Christopher Perri filed for CD21 last quarter but is shown in CD25 this quarter. Not sure if one or the other is an error – he wasn’t listed as a candidate in a recent story about CD25 – but do note that Congressional candidates are only required to live in the state, not in a particular district. Debra Kerner had been listed in CD07 before but she has since ended her candidacy.

– Not all candidates in all races are listed. I pick ’em as I see fit.

– It’s really hard to say how much of an effect Harvey may have had on fundraising. As the Trib story notes, it may be that many candidates have largely tapped their easiest sources, and it may be that some donors are keeping their powder dry. We may get some idea when we see the Q4 numbers in January. In the meantime, remember that there’s a long way to go.

– One candidate who does appear to have had a change of fortune, and not for the best, is Colin Allred in CD32. No idea why, again we’ll want to see what the next report looks like.

– Still no candidates of interest in CDs 10, 22, or 24. Sure would be nice to either have someone with juice file, or for someone who is already running to step it up.

No re-rematch for Gallego against Hurd

The third time is not a charm, mostly because there won’t be a third time.

Pete Gallego

Former U.S. Rep. Pete Gallego, D-Alpine, has decided not to try again to reclaim his old seat in Congress.

“Know that my public service is not done, but that for the present, I have decided to forego another run in the 23rd District,” Gallego said in a statement Friday. “I continue to explore options that will allow me to give back to San Antonio and the rest of this great state which has given me and my family so much.”

Gallego had set up an exploratory committee for the seat in July. At the time, he said he was “energized about 2018,” citing a new level of Democratic enthusiasm in the district following the election of President Donald Trump.

In recent weeks, Gallego tried to raise money for his would-be congressional campaign, according to those plugged in with the Democratic establishment donor community — but found resistance after losing twice.

See here for the previous update. On the one hand, Gallego won in 2012 against an incumbent Republican in a district carried by Mitt Romney and every statewide Republican. He led the ticket in a tough loss in 2014, but then failed to win the seat back in a year where Hillary Clinton won the district. He was a fine legislator and he’s a good person, but with the emergence of some other interesting candidates, I can see why the donor community might have wanted to go another direction. Gallego is young enough to run again for something if he wants to – hell, he’d make a pretty good candidate for Governor if he wanted to give that a try and if the Castros figure out what they’re doing. Seriously, someone ought to talk to him about that. Anyway, this probably means the field in CD23 is set, but someone could still jump in.

Jay Hulings

Jay Hulings, a federal prosecutor from San Antonio, said Sunday he could no wait no longer to launch a challenge to U.S. Rep. Will Hurd, R-Helotes. Hulings is an ally of the Castro brothers — U.S. Rep. Joaquin Castro, D-San Antonio, and former U.S. Housing Secretary Julián Castro.

“Washington is so broken and Congress is so broken,” Hulings said in an interview with The Texas Tribune. “There are times when you can sit on the sidelines. This not one of them. I decided I have to get in the fight.”

Hulings is moving quickly to establish himself as a top-tier candidate in what’s expected to be a crowded primary field. His last day at the U.S. Attorney’s Office for the Western District of Texas was this last week. He’s working with the Castros’ political team, and he is expected to soon begin rolling out endorsement from prominent Democratic officials.

Hulings’ entrance into the race was first reported by the San Antonio Express-News.

On Friday, Hurd got another Democratic challenger: Rick Treviño, a teacher from San Antonio who ran for its City Council earlier this year and narrowly missed a runoff. He had the backing of Our Revolution, the group aligned with former Democratic presidential candidate Bernie Sanders.

Hulings and Treviño join Gina Ortiz Jones, a former Air Force intelligence officer, in vying for a shot at Hurd in 2018. A number of other Democrats are still looking at the race, including former U.S. Rep. Pete Gallego, the Alpine Democrat who represented the district from 2013-2015.

Hulings has been mentioned in every “who might run in CD23” story I’ve seen, but this is the first mention of Treviño I’ve encountered. Of course, Jones wasn’t in those stories either, so make of that what you will. Hulings was one of the US Attorneys in the Crystal City corruption case; I can’t find any web or social media presence for him. Treviño is a bit of a challenge to Google because there’s a Grammy-winning country musician of the same name, but if you search for “rick trevino bernie sanders” you can find this bio of him. Even without a boost from the court, this is a very winnable race, and there will be national help for it. May the best candidate win.

Court invalidates CDs 27 and 35

We are one step closer to having a new Congressional map.

Federal judges have invalidated two Texas congressional districts, ruling that they must be fixed by either the Legislature or a federal court.

In a unanimous decision Tuesday, a three-judge panel in San Antonio ruled that Congressional Districts 27 and 35 violate the U.S. Constitution and the federal Voting Rights Act. The judges found that Hispanic voters in Congressional District 27, represented by U.S. Rep. Blake Farenthold, R-Corpus Christi, were “intentionally deprived of their opportunity to elect a candidate of their choice.” Congressional District 35 — a Central Texas district represented by Democrat Lloyd Doggett of Austin — was deemed “an impermissible racial gerrymander” because mapdrawers illegally used race as the predominant factor in drawing it without a compelling state interest, the judges wrote.

The 107-page ruling — the latest chapter of a six-year court battle over how Texas lawmakers drew political maps — sets up a scramble to redraw the districts in time for the 2018 elections.

The court ordered the Texas Attorney General’s Office to indicate within three business days whether the Texas Legislature would take up redistricting to fix those violations. Otherwise, the state and its legal foes will head back to court on Sept. 5 to begin re-drawing the congressional map — which could shake up other congressional races when the boundaries are changed.

Here is a copy of the ruling, which was unanimous. Michael Li breaks down what this means.

* TX-27 (Farenthold) and TX-35 (Doggett) need to be redrawn – but we knew that already because the court found earlier this year that the configuration of the districts in the 2011 plan was unconstitutional and the 2013 plan made no changes to those districts.

* No further changes need to be made to TX-23 (Hurd) in light of the changes made by the court in the interim plan that then became the 2013 plan. (It is possible there still could be some changes in the Bear County portions of TX-23 as a result of the dismantling of TX-35 but nothing is required).

* No new opportunity district needs to be created in either the Dallas-Fort Worth area. The court’s ruling finds that claims under section 2 of the Voting Rights Act fail because African-Americans and Latinos are not politically cohesive and that any intentional discrimination was adequately remedied by the interim plan/2013 plan as a result of the creation of TX-33 (Veasey).

* No new section 2 district needs to be created in Harris County because African-Americans and Latinos are not politically cohesive.

* BIG FINDING: The court held that the 2013 plan, like the 2011 plan, was intentionally discriminatory. This ruling will play an important role when it comes time for the court to consider whether to put Texas back under preclearance coverage under section 3 of the Voting Rights Act.

From my layman’s perspective, this is a pretty good ruling for the state. CD23 remains intact (though it could be affected by the redrawing of the other two districts), and no new minority opportunity districts need be drawn. The ruling of intent to discriminate is the killer for them, though, as it could mean being put back under preclearance. All things considered, I figure this moves two seats to the Dems, with CD23 remaining a tossup. I suppose Greg Abbott could call another special session to draw a compliant map – they may need another one for the State House soon, too – but I don’t expect that. My guess is the state appeals in the hope of pushing the day of reckoning off into the future, if not winning outright. Stay tuned. The DMN, the Chron, and the Lone Star Project have more.

We have our first declared challenger in CD23.

U.S. Rep. Will Hurd, R-Helotes, is getting his first major Democratic challenger for re-election in Texas’ swing 23rd congressional district.

Gina Ortiz Jones, a former Air Force intelligence officer, is entering the race Wednesday, wading into a potentially crowded primary field for a shot at Hurd, who is widely viewed as the most vulnerable Republican member of Congress from Texas.

Jones said she was inspired to come home to San Antonio and run for Congress after witnessing up close the opening months of Donald Trump’s presidency as a staffer in the Office of the U.S. Trade Representative, which operates from within the Executive Office of the President.

“These policies were directly threatening the opportunities” I had growing up, said Jones, a first-generation American. “To me, it was quite clear that I needed to serve my country and my community in a different way.”

A graduate of John Jay High School in San Antonio, Jones attended Boston University on a ROTC scholarship and served in the Air Force from 2003-2006, deploying to Iraq. After a stint in the private sector, she went to work for the Pentagon’s Defense Intelligence Agency in 2008, ultimately becoming a special adviser to the deputy director. In November, she moved to the Office of the U.S. Trade Representative, where she worked until June.

Although Jones is the first major Democrat to launch a challenge against Hurd for 2018, at least three others are considering a run. They include Judy Canales, a former Obama and Clinton appointee; Jay Hulings, a federal prosecutor from San Antonio; and former U.S. Rep. Pete Gallego, the Alpine Democrat who represented the district from 2013-2015 and unsuccessfully challenged Hurd last year.

You can find a brief bio of Gina Ortiz Jones here; scroll down a bit. I received a press release with a much longer bio after I did my initial draft of this post, so it’s beneath the fold. Her campaign website is here and her campaign Facebook page is here; both are still bare bones, but one presumes that will change shortly.

As for other candidates, Pete Gallego has said he is seriously considering running again, but has yet to take the plunge. Canales and Hulings, I have heard nothing about, and no one has done any fundraising yet. Which is not that big a deal, as there will be plenty of national support for this race, but sooner is always better than later.

Like many other Democrats jumping into these races, Jones looks impressive, and is also younger than I am, which Lord knows we could use more of. She joins MJ Hegar as a veteran who is now a candidate. This could be a very interesting primary, as Gallego (of whom I am very fond) tends to lean towards the centrist side of things. Regardless, I don’t know how you can look at the large and growing crop of solid candidates we have running and not get excited by them.

How the redistricting case could play out

Michael Li games out how the Texas redistricting litigation may go from the anticipated court ruling to final resolution.

So, in short, Texans could end up with a new set of maps (drawn by the Texas Legislature or drawn by the court or drawn by the legislature and then tweaked/modified by the court). Or the whole process could be put on hold [until] the Supreme Court rules on whether there are underlying violations that require redrawing of the maps.

In any event, maps may not be final until early 2018. That would mean, at a minimum, that candidate filing deadlines for state house and congressional races will be moved (and potentially much angst for those thinking about running for those offices). Depending on how long it takes for the Supreme Court to rule, it is possible that the entire March 2018 Texas primary might have to be moved or, in the alternative, that the primary might be held in two parts – one part for congressional and state house races and one part for everything else).

I jumped ahead to the conclusion in Li’s piece. Go read the whole thing to see how he arrived there. Along the way, he cited this Upshot post about possible outcomes in the Congressional map.

Texas’ defense seems simple. How could it have discriminated in adopting a court-drawn map? The problem: Two of the districts found to be in violation in the April ruling were unchanged on the court-drawn map.

Short of victory, the best case for Texas Republicans might be a ruling confined to those two districts. It would probably cost them one seat in the Austin area, most likely the one belonging to Roger Williams.

But the challenge is far wider.

A third district was found to be in violation in April; it was altered on the temporary map, but only slightly. That district belongs to Will Hurd, already one of the most vulnerable Republicans in the country. He won both of his elections by the margin of the high-turnout Republican suburbs of San Antonio, which were said to dilute the power of the district’s low-turnout Hispanic majority. Without those high-turnout Republican suburbs, Mr. Hurd’s re-election chances would look bleak, especially in what is already shaping up as a tough year for Republicans.

The April decision also left open the possibility that Texas might be required to draw an additional minority opportunity district — where the goal is to give racial or ethnic minorities the sway to elect the candidate of their choice — in the Dallas-Fort Worth area. If that happened, a Republican seat would need to be sacrificed here as well, most likely Joe Barton or Kenny Marchant, or perhaps the district held by Sam Johnson, who is not going to seek re-election.

What would “Armageddon” look like? Well, the likeliest version is the possibility that such changes to a few districts ripple across the map, endangering additional Republican incumbents.

The “Armageddon” scenario was reported on by the Trib in late May, which I blogged about here. The worst case scenario for the Republicans is a loss of six, maybe even seven, seats. That’s unlikely, but the low end is two seats, and that may not be much more probable. We won’t know what the scope may be for a few more weeks, when the court’s ruling comes down, and we may not know for certain until January or February. If you thought the 2012 primaries were fun, just you wait for 2018.

July 2017 campaign finance reports – Congress

It’s July, and that means it’s campaign finance report season. Everyone has reports due at the end of June, so at every level of government there are reports to look at. I’ll be working my way through them, starting today with reports from the many people running for Congress as Democrats this cycle, some of whom have done very well in the fundraising department. I don’t have all of the candidates in here – there are over 100 reports, including incumbents, candidates from past races who are not active, and people who raised no money – just the ones I felt like mentioning. It’s a bit arbitrary, but I basically included races that had at least one candidate of interest to me. I did not include every candidate from every race – I skipped people in CDs 02, 21, and 32, in particular. Some candidates of interest are not here, specifically Veronica Escobar in CD16, MJ Hegar in CD31, and Pete Gallego in CD23; Escobar has not made her entry official as yet, and both Hegar and Gallego got in too late to have anything to file about.

With all those preliminaries out of the way, let’s note that the top story here is the large number of large numbers. Four Republican incumbents were outraised last quarter by at least one of their Democratic opponents – Ted Cruz, Ted Poe in CD02, John Culberson in CD07, and Lamar Smith in CD21. Pete Sessions in CD32 only just outraised Ed Meier, and once you add in Colin Allred he trailed the Democratic candidates significantly. Suffice it to say, we have never seen anything like this, certainly not since the DeLay re-redistricting. All of these Republicans have an overall cash on hand advantage, but it won’t be anywhere near the kind of advantage they’re used to. When Hegar and Gallego get up to speed, I expect both of them will be in the same class as their peers in these races.

The redistricting ruling is likely to have an effect on this for the next quarter as well. All of the maps presented by the plaintiffs created another Democratic district in the D/FW area, which was usually drawn as CD24, and significantly reconfigured CD27 as well. Neither of those districts currently has anyone who filed a finance report as a Dem, but if one of these maps or something like them gets adopted for 2018, that will change in a hurry.

Disclaimer time: Money isn’t everything, and fundraising isn’t destiny. But think of all the times you’ve heard people complain – or you yourself have complained – about Texas acting as an ATM for campaigns everywhere else. This is all money being raised for candidates here, and it’s happening in a year where there are and have already been plenty of opportunities to fund campaigns in other states. This is a level of enthusiasm and engagement we are not used to seeing. I don’t know how this will all turn out – these are still Republican districts that will take a major shift in the electorate to be competitive. Right now, a lot of people think that’s possible, and they are literally putting their money where that belief is. I don’t see how this is anything but good news.

Will we have enough candidates for the opportunities?

There’s always something to worry about.

With the Texas case moving forward, the boundaries of the congressional districts remain in question with the 2018 elections less than 18 months away. The Lone Star State’s primary filing deadline is in six months.

So, incumbent lawmakers and potential challengers are watching to see where the districts’ boundaries will fall, and weighing how that could affect the outcomes in next year’s midterms.

National Democrats have heard from candidates interested in [CD23]. And while they expect strong challengers to emerge, none have so far.

“Everyone’s kind of keeping their powder dry until it makes a little more sense to announce,” said [Colin] Strother, the Democratic consultant.

The court also ruled two other districts were unlawful: the 35th District, which stretches from San Antonio to Austin, and is represented by Democrat Lloyd Doggett; and the 27th District along Texas’ central Gulf Coast, represented by Republican Blake Farenthold.

[Michael Li, senior counsel at the Brennan Center for Justice] speculated that, if the court rules the current map is also invalid, a new congressional map could lead to two or three more Democratic seats. Republicans currently outnumber Democrats, 25 to 11, in the Texas delegation.

But one GOP consultant focused on Texas did not believe a new map would result in a significant shift against the Republicans.

“There’s just not enough Democrats to roll around the state to really have massive amounts of change,” the consultant said. “You may lose one seat.”

The consultant also said the uncertainty would not have an effect on congressional campaigns for incumbents, since they are accustomed to the constant legal battles over the congressional lines.

But Strother said Democrats had to be prepared just in case.

“The nightmare scenario for Democrats is we don’t have people preparing for the emergency that this district or that district suddenly gets great for Democrats … and it’s too late,” he said.

Strother said he didn’t see many Democrats preparing for races just yet, but pointed to Joe Kopser in the 21st District as someone jumping in early in a race rated Solid Republican by Inside Elections.

Kopser, an Army veteran and technology businessman, recently announced that he would challenge GOP Rep. Lamar Smith in the central Texas district. It is possible a new congressional map could have a ripple effect and alter the lines of Smith’s district.

While the district is not on the Democratic Congressional Campaign Committee’s list of 2018 targets, the committee is waiting to see how the redistricting case pans out.

I’m not worried about this. Districts that aren’t likely to change or which won’t change that much ether already have candidates or candidates in waiting – Pete Gallego is circling around CD23, for one, and there are other candidates looking at it as well – and in the districts that may change a lot, like CD27, there’s really no choice but to wait and see what they actually look like. Sure, Republican incumbents who are already sitting on a decent pile of campaign cash will have an advantage, but that was always the case, and it may not matter that much in any event, depending on how the districts get drawn. As far as CD21 goes, a look at the FEC reports shows that there are at least three other candidates running against Lamar Smith, one of whom has been out there for a couple of months. We’re going to have plenty of candidates, and some of them will have a decent chance of winning. It’s all good.

Less than a year after he lost his bid to reclaim his U.S. House seat, former U.S. Rep. Pete Gallego, D-Alpine, is seriously considering another run for Congress, citing shifting political winds in Texas’ 23rd congressional district following the election of President Donald Trump.

A 2018 campaign would be Gallego’s third against U.S. Rep. Will Hurd, R-Helotes, who unseated the one-term Gallego in 2014. Gallego then unsuccessfully challenged Hurd two years later, losing by 3,051 votes — an outcome Gallego believes would be much different if the election were held today.

“It’s certainly a different environment out there today than it was six months ago,” Gallego said in an interview. “I have seen a lot of energy and enthusiasm in Democratic ranks — more than I’ve ever seen.”

“Frankly I’m energized about 2018,” Gallego added.

Gallego could have company in the Democratic primary, where Jay Hulings, an assistant U.S. attorney from San Antonio, and Judy Canales, a former Obama and Clinton appointee from Eagle Pass, are also weighing campaigns. State Rep. Cesar Blanco, D-El Paso, was seen as a possible candidate for the seat but announced last month he will seek re-election to the Texas House.

Hulings’ name came up in some very early speculation about who might run for what next year; this is the first time I’ve heard Judy Canales’ name. I can tell you that as yet no one has filed an FEC finance report, so as of today there are no actual candidates, just theoretical ones. The story suggests, and I have no doubt, that people are waiting to see what the court will do in the redistricting case, given that CD23 is one of the districts at issue. Time is less of a factor here in that as soon as there are any candidates for CD23 they should have no trouble garnering contributions. The amount of money already coming in to candidates in districts far tougher than CD23 is staggering – the contenders in CD07 combined to raise in excess of $1.2 million, for example. Whoever runs in CD23 will have the resources to run a competitive race. It’s a matter of who that will be and what the district will look like.

Let a thousand hypothetical alternative Texas Congressional maps bloom

Stephen Wolf of Daily Kos Elections takes a crack at drawing a remedial Congressional map for Texas.

Just how effective is GOP gerrymandering in Texas, and what might a redrawn map look like in 2018 as a consequence of a favorable court ruling? To answer these questions, we’ll analyze a hypothetical fully nonpartisan congressional map below as part of our ongoing series on how Republican congressional gerrymandering affected the 2016 elections. We drew this map by balancing traditional nonpartisan redistricting criteria such as preserving communities of interest, minimizing city and county divisions, respect for the Voting Rights Act, and geographic compactness, while ignoring factors like where incumbents live.

To ensure that our hypothetical nonpartisan congressional map complies with the Voting Rights Act and past Supreme Court precedents, we have estimated the Citizen Voting Age Population (CVAP) according to the 2008-2012 American Community Survey in addition to the official 2010 census population figures. Since Texas has a large and disproportionately Latino non-citizen population, all demographic figures given below refer to CVAP unless noted. We have additionally calculated results by district for every statewide partisan race from 2016 back to 1996 using the Texas Legislative Council’s redistricting data sets, and you can find all of those demographic and election statistics here.

Before we delve into the map, we’ll start with a quick note about what the Voting Rights Act requires. The VRA protects racial or ethnic minority groups in certain districts where there is 1) racially polarized voting, 2) a compact minority population, and 3) a majority population that would otherwise vote as a bloc to defeat candidates chosen by minorities. The VRA does not require that these districts elect a representative who belongs to the protected racial or ethnic group, just that the group can elect its chosen candidates, who may happen to be white.

As the Supreme Court has emphasized in recent racial gerrymandering rulings, a single racial minority group does not actually need to comprise an absolute majority of a protected district’s population so long as the group can reliably elect its candidate choice in that district. Consequently, black VRA districts often do not need to be majority black, while Latino VRA seats sometimes need to be considerably more than 50 percent Latino due to low turnout rates.

With those VRA requirements in mind, here is our proposed nonpartisan Texas congressional map.

As shown below, our fully nonpartisan congressional map likely would have given Texas Democrats four or five extra House seats in 2016. Those districts include the 2nd in west Houston, the 6th in Ft. Worth, the 10th in central Austin, and the 23rd in San Antonio and El Paso, while the 25th in suburban Austin could’ve gone either way. Additionally, the GOP-held 32nd District in northern Dallas becomes slightly bluer, meaning this map’s impact could grow in future elections.

As we explained above, even if the court strikes down the GOP’s gerrymander and orders the state to draw new districts, it’s likely that Republicans will be able to draw a new gerrymander under additional constraints. Such a scenario would likely see Democrats and Latinos gain at least two seats between South Texas and Austin.

However, it’s an open question whether the court would require a new seat in Dallas-Ft. Worth that would likely elect a third extra Latino Democrat at the expense of a white Republican. The GOP would likely still get to gerrymander in Austin, Houston, and northern Dallas, but two-to-three extra safe seats would be a big deal for Democratic hopes of a House majority in 2018.

Conversely, if Texas Republicans for some reason do not get the opportunity to draw a new map and the court does it for them, the GOP really could be facing the “Armageddon” scenario that it fears. Regardless, we have demonstrated how Republican gerrymandering produces a monumental difference in the Lone Star State’s congressional delegation, and it likely cost Democrats more seats in 2016 than in any other state.

Go read the full writeup, which is very detailed. A 21R/15D split, which this map would produce if the swing CD25 stayed Republican, would be pretty representative of statewide voting patterns, basically giving Republicans 58.3% of the Congressional seats. That’s in line with my own calculations, though of course that will be a moving target over time and across Presidential/non-Presidential years. One local effect of this map would be that the gaggle of contenders in CD07 would need to refile in CD02, if they wanted a winnable race. If nothing else, this particular map is a model of compactness – there are no districts that look like they fell out of a Salvador Dali painting. The trial is now over, so this is more of an academic exercise than anything else; I don’t know if it would have been possible to file something like this as an amicus brief for the trial, but it might have been interesting to have done so. Anyway, take a look and see what you think.

Republicans are a little freaked out over Texas Congressional redistricting possibilities

I referenced this Trib story in last Friday’s post about the state declining to do a special session on redistricting, which at least some members of Congress from Texas would have liked. There was more to this story, which I want to focus on in this post.

Even as a tax code overhaul and the investigations into Russian interference in the 2016 elections dominated the news in Washington this week, it was redistricting that absorbed many of the Texans. But the Texas GOP delegation concerns are evolving into a national worry.

As President Donald Trump’s approval ratings flag, control of the U.S. House increasingly appears up for grabs in the 2018 midterms. Republicans are counting every seat on the map, and the fear is that a newly drawn Texas seat will put even more seats into play.

According to one member, “a frantic call was put out” and GOP members of Congress from Texas met at the Republican National Committee on Tuesday night for a presentation of an “Armageddon map.” Republican attorneys and at least one party official showed many in the delegation a potential worst-case scenario if the 2018 Texas map is drawn by the three-judge panel. This potential map could jeopardize as many as a half-dozen Texas GOP incumbents and create ripple effects on the lines of many others.

The presentation did much to deeply rattle several Republican delegation members, according to people who attended the meeting. The RNC declined repeated attempts to respond to requests for comment.

But some sources within the delegation emerged from the Tuesday night meeting dubious of the frantic tone.

Emphasis mine. I’m not sure where that number comes from, as there are only three seats currently held by Republicans that were singled out by the court – the 23rd, the 26th, and the 27th, with the 26th being at a lower level of concern. The 35th was also cited, but it’s held by Democrat Lloyd Doggett. I’ve been trying to come up with a list of six potential Democratic pickups, combining both the potential new map and the three DCCC-targeted districts. This is what I’ve come up with:

– A redrawn CD23 is highly likely to be lost by the GOP. It won’t take much to change it into a Democratic-majority district.

– There were maps drawn by various Democratic groups during the 2011 process that created a second minority-majority Democratic seat in the D/FW area, to go along with CD33. Let’s say this is the new CD26, for the sake of simplicity.

– I suppose CD27 can be redrawn in a more Dem-friendly way, though it was a 60-40 district in 2016 and wasn’t any more Democratic that year than it was in 2012. But let’s assume it can be done.

– Throw in CDs 07 and 32 as potential victims of a strong Democratic year in 2018, and you’re up to five seats. CD32 could be affected by a redrawn CD26, but if it is it seems likely to me to be more Republican, since those voters will have to go somewhere to create room for a new Dem district. But let’s assume any such effect would be minimal.

– That still leaves one more seat. The next ones down the list are CDs 24 and 02, which would probably be more the effect of a super-strong Democratic wave instead of just an ordinary strong Democratic wave. If the GOP is freaking out about this, they have bigger problems to worry about than a new Texas Congressional map.

Realistically, I think a new court-drawn map puts CD23 firmly into “Dem-favored” territory, and I think another Dem seat, possibly in the Metroplex and possibly in place of CD27, gets drawn. Maybe both, but surely one. CDs 07 and 32 will be as competitive as the 2018 environment allows; per Nate Silver, if the “Montana special election environment” is in place next November, I’d consider both of them to be in play. So a reasonable hope for two or possibly three seats, with an outside shot at four or five, and anything more than that being a bluest-of-blue skies scenario. I can see why Republicans might be a little spooked by that. For what it’s worth, Republicans “deserve” between 20 and 23 of the 36 Congressional seats – between 55.6% and 63.9% – based on statewide performance; they now have 25, or 69.4%, of the seats. So a Dem pickup of two to four seats would put the ratio about where it “should” be. Just something to keep in mind.

On Wednesday, two Texas Democrats are launching separate campaigns for Congress in a district that’s served as a Republican stronghold since the congressional days of former President George H.W. Bush. One is Alex Triantaphyllis, director of BakerRipley, a community development non-profit; the other is Dr. Jason Westin, a cancer research doctor at MD Anderson.

They are not alone. Four other Democrats have filed campaign papers with the Federal Election Commission, and one other is expected to soon. That’s in addition to two independent candidates, and one Republican primary challenger: Houston businessman David Balat.

Another potential GOP primary challenger is Maria Espinoza, a conservative activist and high profile Trump campaign booster.

Altogether, there could be a dozen candidates, including Culberson, contending in a Texas congressional election that’s still 18 months away.

“The results of the 2016 election in this district show that the people in this area are concerned about the direction that the president might take us, and I think they will become increasingly concerned that Congressman Culberson has stood with Trump,” said Triantaphyllis.

Westin also sees growing anti-Trump sentiment, particularly around the GOP’s latest Obamacare replacement bill, which Culberson supports. “There are a lot of smart people that don’t buy into some of the circus tricks that Mr. Trump is doing,” he said. “The enthusiasm of the grassroots movement is exciting.”

As you know, I’ve been tracking potential candidates for CD07 for some time now. This story doesn’t add any new names, at least not on the Democratic side. Balat is new (at least to me), while Espinoza ran against Culberson in the 2016 primary along with a third candidate, receiving 17 percent of the vote. I have no idea who the two independent candidates may be, but given that one needs to file a declaration of intent to run as an indy during the regular filing period (which doesn’t begin until November) and also collect 500 valid petition signatures from registered voters in the district who didn’t vote in the primary or primary runoff for either party for that year’s election (i.e., the 2018 primary) in the time period between the primary and 30 days after the runoff in order to qualify for a spot on the ballot, it may be a tad bit premature to care about their identities.

Joshua Butler, another candidate for CD07, recently posted a picture on Facebook of finance report data for several of the contenders in that district. I wouldn’t read too much into that – anyone who still has an active treasury, even if they are not currently a candidate, has to file a report – but it’s another way to keep track of who may be in. The first quarter ended on March 31 and as was the case with Beto O’Rourke’s announcement for the Senate, April and now May are busy times for new candidates to make themselves officially known. The next round of reports in July ought to be quite interesting.

Something strange is happening in Texas lately: Ambitious Democrats are coming out of the woodwork to run for Congress in places few in the party paid attention to even just a year ago.

Take the 7th Congressional District currently represented by Houston Republican John Culberson. Four Democrats had already filed for the seat before Wednesday morning, when two more jumped in.

“I’m running for Congress because I think we need to hold the president accountable,” said Alex Triantaphyllis, the director of Immigration and Economic Opportunity at Neighborhood Centers Inc., a Houston nonprofit. He said his young daughter was a motivating force for his run.

“I want her to know that we got results in our efforts, that we didn’t just have good intentions,” he added.

Jason Westin, a cancer researcher, was thinking along similar lines Wednesday morning.

“The politics of late is prompting me to say this is enough, and we need to get new people who aren’t the typical politicians..and get off the sidelines and do something,” Westin said, after his own announcement.

In past cycles, national Democratic groups had a heavy hand in candidate recruitment and telegraphed favored candidates to donors and reporters. This time around, thanks to a burst of anti-Trump enthusiasm and wounds from the 2016 presidential primary fight, party brokers are letting the primary process run its course without playing favorites in many districts around the country – including in Dallas and Houston.

The net result is a crush of candidates lining up to run for office, including three who announced their campaigns on Wednesday.

Triantaphyliss and Westin joined a crowded field vying to run against Culberson that already included Joshua Butler, James Cargas, Debra Kerner and Laura Moser.

ding! New candidate name alert! This is the first mention of Laura Moser as a potential candidate that I have seen. I don’t see any evidence of a campaign website or Facebook page, but Moser has been very actively engaged and has a connection to the Obama administration, so it’s easy to see where that might come from. I do note that Collin Cox, who was in that “very early speculation” post, was not mentioned in either of these stories, which may mean he’s already decided not to run or may mean he just hasn’t made any further steps towards running yet.

I should note that I received press releases from Westin and Triantaphyliss with their announcements, and later in the day I got one from Kerner, who made her own announcement. I’ve put them all beneath the fold. Looks like I may need to get going on creating an Election 2018 page, which means I’ll also need to create an Election 2017 page. It’s crazy.

Back to the Trib story:

Up north in Dallas, former Hillary Clinton staffer Ed Meier also announced he would join former NFL player Colin Allred in running for the Democratic nomination to take on U.S. Rep. Pete Sessions. Four other filed candidates – Awbrey Tyler Hughlett, Stephen Leroy Love, Ronald William Marshall and Darrell Allen Rodriguez – have also filed to run for the seat.

Party officials anticipate even more candidates to run in both districts.

“It is extremely unique – we don’t usually have this volume of conversations by April of the off-year,” said Jeff Rotkoff, of candidate outreach to his organization, the Texas AFL-CIO. “We have more interest in people running for Congress than I’ve ever experienced in my career.”

The DMN also notes Meier’s candidacy in CD32. I’m going to guess that the reason there isn’t an equally big rush towards CD23, which is the bluest of these three Clinton-carried districts, is that its status is in a bit of limbo due to the redistricting litigation. I figure someone will come forward in that district sooner or later anyway.

I said before that I believe there is a limit to how many candidates can and will run in these primaries. There’s only so much money and volunteer energy to go around. We won’t know for sure until the filing season officially opens. But so far at least, it’s looking like I may be wrong about my belief in the natural size of these races.

UPDATE: Naturally, as I had drafted this post based on the early version of that Chron story, the fuller version of that story then came out. I would have written this differently if I had only seen the later version, but them’s the breaks. This version includes more names and covers a lot of the same ground as the Trib story, and it throws a couple of new names into the mix as well:

In addition to the six Democrats who have formally announced or filed federal election papers, Houston trial lawyer Lizzie Pannill Fletcher told the Chronicle on Wednesday that she is “very close to making the decision to step into this race.”

Ronald Kimmons, a former missionary and Reform Party member who works as a writer and translator, rounds out the field.

Like I said, you’re going to need a scorecard to keep up with all the names. I’m going to do my best to try.

Precinct analysis: Congressional districts

The Texas Legislative Council now has full data from the 2016 elections on its site, so this seemed like as good a time as any to take a look at the data from Congressional districts. I’m much more limited in what I can do when I have to rely on precinct data from counties because most of Texas’ Congressional districts span multiple counties. But now statewide data is available, so here we go. I’m just going to look at districts where the Presidential numbers were interesting.

Some of this we’ve covered before – CDs 07, 23, and 32 are well-known and are on the national radar for next year. CD03 will be open following the retirement of Rep. Sam Johnson. CDs 24, which is mostly in Dallas County, and 22, which is of course Tom DeLay’s old district, deserve a bit more attention and would fall into the next tier below the top three, with CDs 02 and 10 right behind them. And as a matter of personal pleading, I’d really really love to see strong challenges to Lamar Smith in CD21 and Smokey Joe Barton in CD06, two of the worst anti-science and pro-pollution members of Congress.

Now as we know, the Presidential numbers only tell us so much. So as I have done before, here’s a look at the Court of Criminal Appeals races in these districts – just the one in each year that had three candidates, for apples-to-apples purposes – and for this chart I’m going to chow number of votes, to give a feel for how big the gap that needs to be closed is.

A bit more daunting when looked at this way, isn’t it? The “D Gain” column is the net change in the difference between the Republican and Democratic candidates’ vote totals each year. In 2012 in CD02, Sharon Keller beat Keith Hampton by 64,695 votes, but in 2016 Mike Keasler beat Robert Burns by “only” 51,059 votes, for a net Democratic gain of 13,636. This is intended to give a rough guide to what the partisan shift in each district was, and as you can see it was much bigger in some than in others, with there being a net loss in CDs 06, 10, and 31. I have to pause for a moment here to tip my cap to Rep. Will Hurd in CD23, who held his seat in a much less Republican-friendly environment that elected Pete Gallego in 2012. No one in CD23 will ever have an easy election, and 2018 may well be more challenging for Hurd than 2016 was, my point here is simply to say that we should not underestimate this guy. He’s already shown he can win in adverse conditions.

Still, sufficient Democratic turnout could swamp Hurd’s boat, as has happened to other strong candidates of both parties in the past. (A less-Republican redrawn map could also do him in.) The Keasler/Burns numbers suggest that the other two on-the-radar districts (CDs 07 and 32) are also good targets for concentrated turnout efforts. In all cases, though, I believe a key component to any winning strategy will be to make a vote for Congress as much about “sending a message” to an unpopular and incompetent President as anything else. The more Rs you can flip, and the more who decide to stay home, the lower your turnout-boost goals need to be. I don’t know what the conditions will be like in a year and a half, but I do know that energy spent between now and then in these districts to register new voters (and re-register those who have fallen off the rolls) will be energy well utilized.

I will close by noting that there is in fact a candidate for CD21 at this time, Derrick Crowe, who has a pretty good looking background for a first-time candidate. We’ll see how he does in fundraising and other metrics, but for those of you in the district or who are looking for someone to support against the odious Lamar Smith, check him out. It’s never too early to get off to a good start.

Big day for redistricting in court

Tomorrow the questions of what happens next in the redistricting lawsuits begin to get answered.

Will Texas soon see new political maps that are friendlier to Latino and black voters and, in turn, Democrats? If so, who would draw them: the scolded Republican-led Legislature or the courts themselves? Will the maps land ahead of the 2018 elections?

A three-judge panel based in San Antonio will start wading through such questions on Thursday as lawyers for each side of the redistricting dispute return to court for a high-profile status conference.

“This hearing is a very important event in the sequence of what’s going to happen,” said Jose Garza, an attorney for the Mexican American Legislative Caucus, a plaintiff in the case.

In a 2-1 March ruling, the San Antonio panel ruled that Texas lawmakers knowingly discriminated in drawing three of the state’s 36 congressional districts: CD-23, represented by Will Hurd, R-Helotes; CD-27, represented by Blake Farenthold, R-Corpus Christi; and CD-35, represented by Lloyd Doggett, D-Austin.

And last week the same judges found fault with the 2011 state House map, finding that lawmakers intentionally diluted the clout of minority voters statewide and in districts encompassing areas including El Paso, Bexar, Nueces, Harris, Dallas and Bell counties.

Each ruling matters mightily because, if they withstand appeals, they could ultimately land Texas — which has a well-documented history of racial discrimination in elections — back on a list of states needing outside approvalto change their election laws.

More immediate questions, however, surround what the rulings mean for the 2018 elections since new district lines could affect both voters and candidates. Already, one potential U.S. House candidate — former U.S. Rep. Pete Gallego — told The Texsas Tribune he would consider running again for Hurd’s CD-23 seat, but perhaps only under new boundaries.

Civil rights groups and other plaintiffs argue that 2011’s discrimination carried over to the maps currently in use.

Nina Perales, representing the Mexican American Legal Defense and Educational Fund in the lawsuit, suggests the case against the 2013 congressional maps is more straightforward partly because there are fewer districts in play and also because the court’s decision more clearly identified discrimination that carried over into the new maps. For instance, the boundaries of two of its districts — Farenthold’s 27th and Doggett’s 35th — are identical to those drawn in 2011.

“We get a better picture on the Congress decision about where the court thinks the map is still flawed,” Perales said. “We do not get a sense in the House opinion where the court thinks the 2013 map is flawed.”

There are a lot of questions for the court to address – Michael Li rounds up and summarizes the remaining disputes for the Congressional plan; there are no doubt at least as many issues still in contention for the State House plan – and not a lot of time to get something in place for the 2018 filing season, which begins in a bit more than six months. The plaintiffs had previously proposed a schedule that would have the state submit a remedial map by May 5, with a final decision in place by July 1. A similar schedule for the State House districts would mean a state-proposed remedial map by the beginning of June, with a final decision by early August. That actually gives the Legislature enough time to pass new maps if they want to, but with little room for delay. I can’t wait to see what the judges say.

Very early speculation about Congressional campaigns

The Trib rounded up all the scuttlebutt about who may be running for various Congressional districts next year. I’ve picked out a few to comment on.

CD07:

National Democrats are interested in Houston attorney Collin Cox and Alex Triantaphyllis, the director of Immigration and Economic Opportunity at Neighborhood Centers Inc., a Houston nonprofit, as possible recruits.

Conservative groups have also hinted at a possible primary challenge to Culberson. The Club for Growth just announced it was launching a TV ad in his district urging him to oppose a border adjustment tax.

There are four other candidates orbiting around CD07 that I know of; this is the first I’ve heard these two names. I’ve met Cox, who I know has been a contributor in numerous city races. I’ve not met Alex Triantaphyllis, but I assume he is related to Tasso Triantaphyllis, who was a Democratic candidate for district court judge in 2002. I don’t think there’s enough room in a Democratic primary for a traditionally Republican Congressional seat for six candidates, but who knows? And while Cox and Triantaphyllis may have caught the eye of the DCCC, this is one of those times where that probably doesn’t matter much, at least not for March. People are paying attention to this race now – there’s already a candidate forum for May 9 – and I daresay anyone who wants to make it to a runoff next year needs to be out there attending meetings and rallies and talking to people. Don’t sleep on this.

CD16:

El Paso County Judge Veronica Escobar, a Democrat, is at the center of local and Washington speculation but is taking her time deciding on making a run official.

Other contenders are watching her movements, and they may soon get impatient. Other frequently mentioned names include state Rep. Cesar Blanco, who is well-regarded in Washington from his days as a staffer in the U.S. House to Democrat Pete Gallego. He is also mentioned as a potential Democratic recruit for the 23rd District.

This is the seat that Beto O’Rourke will be vacating. It makes sense for this Democratic seat to have a crowded primary, so assume there are plenty of other hopefuls looking at it. I’ve been impressed by Rep. Blanco, but it’s way early to speculate.

CD23:

The key here, in the Democratic worldview, is whether the 23rd District’s lines are redrawn amid ongoing redistricting litigation. Should new lines make this district easier for Democrats, look for a competitive primary.

Hurd’s rival from the past two cycles, Democratic former U.S. Rep. Pete Gallego, told the Tribune he would consider running for the seat again under new lines.

“If there’s a new map, then there’s a new race,” Gallego said. Other Democrats are likely to give the seat a serious look, including Blanco, the El Paso-based state representative.

But national Democrats are also looking into an up-and-comer in San Antonio: Assistant U.S. Attorney Jay Hulings. A former Capitol Hill staffer on the House Permanent Select Committee on Intelligence, Hulings is a member of the Castro twins’ Harvard Law School class.

Whether there are changes to this district or not, Rep. Hurd will be a tough opponent. He may get swamped by national conditions, but it will take some work to tie him to Trump. I’ve always liked Pete Gallego but after two straight losses it might be time for a different candidate.

CD27:

This is the general election race most reliant on external factors.

Former state Rep. Solomon Ortiz Jr. told the Tribune he is considering a Democratic run for this Corpus Christi-based seat — but on the condition that the district’s lines change amid ongoing redistricting litigation.

This one is only interesting if the state’s attempts to delay or deny a new map are successful. I wish it were different, but CD27 was slightly redder in 2016 than it was in 2012, so new lines are the only real hope.

CD32:

There is no shortage of Democrats considering a challenge to Sessions. Dallas school board member Miguel Solis, Children’s Medical Center senior vice president Regina Montoya, former NFL player Colin Allred and former Hillary Clinton staffer Ed Meier are frequently named as possible recruits.

Allred is officially in.

Civil rights attorney Colin Allred has launched a campaign to unseat Rep. Pete Sessions of Dallas.

But first the former NFL player will have to run in a potentially crowded Democratic primary for the 32nd Congressional District. A former Hillcrest High School standout, he hopes his connection to the North Dallas district attracts him to voters.

“I was born and raised in this district by a single mother who taught in Dallas public schools for 27 years,” Allred said. “This community — my mom, my teachers, and my coaches — gave me the opportunity to succeed, play in the NFL, become a civil rights attorney and work for President Obama. I want to make sure future generations have the same opportunities and to make sure those values are being represented in D.C.”

Allred, 34, told The Dallas Morning News that he was inspired to challenge Sessions by the “grassroots energy” displayed after the 2016 election of President Donald Trump.

Sounds pretty good to me, but as noted he will not have a clear field. One primary opponent he won’t have is Miguel Solis, who says in the story that he will not be a candidate. We’ll see who else gets in, but I am looking forward to hearing more from Colin Allred.
